Sewer Use Regulations: The majority of the Commission’s stormwater management<br />

controls are enforced through its Regulations Governing the Use of Sanitary and<br />

Combined Sewers and Storm Drains (the Sewer Use Regulations). The Sewer Use<br />

Regulations were adopted in 1983 and amended in 1989. They were amended again in<br />

1998 to strengthen and clarify the requirements, particularly as they pertain to stormwater<br />

discharges. In 1998, the Commission also amended its Penalty Schedule by adding and<br />

increasing the fines for several Sewer Use Regulation violations.<br />

General Service Applications and Requirements for Site Plans: The Commission<br />

requires that a General Service Application and a site plan be submitted for every new or<br />

reconstructed water, sewer, or storm drain service connection. The Requirements for Site<br />

Plans are to assist developers, builders, architects, engineers, and others in preparing site<br />

plans that conform to the Commission’s requirements and to help them secure the<br />

necessary approvals from the Commission.<br />

The site plan must be approved by the Commission’s Chief Engineer before construction<br />

may begin, and it will not be approved unless it complies with the Commission’s<br />

Requirements for Site Plans and Sewer Use Regulations. The site plan review provides<br />

an opportunity to review the components of the project and condition the approval on<br />

compliance with the Commission’s Sewer Use Regulations, Requirements for Site Plans,<br />

and other requirements. The Commission’s Requirements for Site Plans are updated as<br />

needed, generally about once a year.<br />

1.4 MUNICIPAL STORM DRAINS OWNED BY OTHERS<br />

The Commission controls most of the municipal storm drains in Boston. However, some<br />

storm drains and outfalls are owned by other city agencies. For example, drains and<br />

outfalls located in the Marine Industrial Park in South Boston are owned and operated<br />

jointly by the Economic Development and Industrial Corporation of Boston and the<br />

Boston Redevelopment Authority (EDIC/BRA); the Boston Parks Department owns<br />

drains in Franklin Park and Boston Common, and in other city parks.<br />

Other storm drains and outfall in the city are owned by state agencies, such as the<br />

Massachusetts Department of Transportation, Massport, and the state Department of<br />

Conservation and Recreation; these drains and outfalls are not controlled by the<br />

Commission.<br />

The Commission also has a number of interconnections with the Town of Brookline,<br />

Town of Dedham, Town of Milton and City of Newton, over which it has no control of<br />

their respective upstream systems. The Commission does not have jurisdiction or control<br />

over these separately owned facilities, nor does it have jurisdiction and/or control over<br />
