On 23 September 2003 in South Melbourne, a WorkSafe inspector attended a building site in
response to a complaint about unsafe work practices. Bailey Heights Pty Ltd was the principal
contractor on site.
The inspector observed the roof did not have handrails or any other form of perimeter protection
erected. The inspector estimated the potential fall height to be approximately 10 metres. It was
a day of high wind and the inspector formed the opinion that the work environment posed an
immediate risk to the health and safety of employees. The inspector ordered that the work on the
roof cease immediately.
After the charges were issued, new material became available that warranted reconsideration of
the charges and a decision was made to withdraw the charges.
Breach: Sections 21(1) & (2)(a) and section 44(3) of the Occupational Health and Safety Act 1985.
Result: Charges withdrawn.
