are constantly in flux—Wikipedia’s articles about Wikipedia note that <strong>the</strong>re is<br />

controversy over <strong>the</strong> “co-founder” label for Sanger. In ano<strong>the</strong>r example <strong>of</strong> <strong>the</strong><br />

lim<strong>it</strong>s <strong>of</strong> direct power, <strong>the</strong>n-Wikimedia Foundation board member Angela<br />

Beesley fought <strong>to</strong> have <strong>the</strong> Wikipedia entry about her deleted. She was rebuffed,<br />

w<strong>it</strong>h administra<strong>to</strong>rs concluding that she was newsworthy enough <strong>to</strong><br />

warrant one. 67 (She tried again after resigning from <strong>the</strong> Foundation board, <strong>to</strong><br />

Wikipedia—w<strong>it</strong>h <strong>the</strong> cooperation <strong>of</strong> many Wikipedians—has developed a<br />

system <strong>of</strong> self-governance that has many indicia <strong>of</strong> <strong>the</strong> rule <strong>of</strong> law w<strong>it</strong>hout<br />

heavy reliance on outside author<strong>it</strong>y or boundary. To be sure, while outside regulation<br />

is not courted, Wikipedia’s policy on copyright infringement exhib<strong>it</strong>s a<br />

desire <strong>to</strong> integrate w<strong>it</strong>h <strong>the</strong> law ra<strong>the</strong>r than reject <strong>it</strong>. Indeed, <strong>it</strong>s copyright policy<br />

is much stricter than <strong>the</strong> laws <strong>of</strong> major jurisdictions require. In <strong>the</strong> Un<strong>it</strong>ed<br />

States, Wikipedia could wa<strong>it</strong> for formal notifications <strong>of</strong> specific infringement<br />

before taking action <strong>to</strong> remove copyrighted material. 69 <strong>And</strong> desp<strong>it</strong>e <strong>the</strong> fact<br />

that Wales himself is a fan <strong>of</strong> Ayn Rand 70 —whose philosophy <strong>of</strong> “objectivism”<br />

closely aligns w<strong>it</strong>h libertarian ideals, a triumph <strong>of</strong> <strong>the</strong> individual over <strong>the</strong><br />

group—Wikipedia is a consummately commun<strong>it</strong>arian enterprise. 71 The activ<strong>it</strong>y<br />

<strong>of</strong> building and ed<strong>it</strong>ing <strong>the</strong> encyclopedia is done in groups, though <strong>the</strong><br />

structure <strong>of</strong> <strong>the</strong> wiki allows for large groups <strong>to</strong> naturally break up in<strong>to</strong> manageable<br />

un<strong>it</strong>s most <strong>of</strong> <strong>the</strong> time: a nano-commun<strong>it</strong>y coalesces around each article,<br />

<strong>of</strong>ten from five <strong>to</strong> twenty people at a time, augmented by non-subject-specific<br />

roving edi<strong>to</strong>rs who enjoy generic tasks like line ed<strong>it</strong>ing or categorizing articles.<br />

(Sometimes articles on roughly <strong>the</strong> same subject can develop independently, at<br />

which point <strong>the</strong>re is a negotiation between <strong>the</strong> two sets <strong>of</strong> edi<strong>to</strong>rs on whe<strong>the</strong>r<br />

and <strong>how</strong> <strong>to</strong> merge <strong>the</strong>m.)<br />

This structure is a natural form <strong>of</strong> what const<strong>it</strong>utionalists would call subsidiar<strong>it</strong>y:<br />

centralized, “higher” forms <strong>of</strong> dispute resolution are reserved for special<br />

cases, while day-<strong>to</strong>-day work and decisions are undertaken in small, “local”<br />

groups. 72 Decisions are made by those closest <strong>to</strong> <strong>the</strong> issues, preventing <strong>the</strong><br />

lengthy, <strong>to</strong>p-down processes <strong>of</strong> hierarchical systems. This subsidiar<strong>it</strong>y is also<br />

expressed through <strong>the</strong> major groupings drawn according <strong>to</strong> language. Each<br />

different language version <strong>of</strong> Wikipedia forms <strong>it</strong>s own policies, enforcement
