6 If the owner is anot for profit organization and it is finan<br />

cially or physically infeasible to achieve its charitable purpose<br />

while confomung to the pertinent architectural standards and<br />

guidelines<br />

7 A court of competent jurisdiction has required the owner to<br />

abate any violation of these ordinances within a time frame<br />

that does not comport with therequirements of this Chapter<br />

In considering granting a Certificate of Economic Hardship the Com<br />

mission may solicit expert testimony or request that the applicant for a<br />

Certificate ofEconomic Hazdship submit evidence concerning property<br />

vatue cost<br />

estimates income expenses and or any other information<br />

that the Commission deems necessary to determine whether the denial<br />

ofthe application constitutes an economic hardship The level ofdocu<br />

mentation required may vary as is appropriate to each case The Appli<br />

cant may submit any personal or proprietary information to the Staffof<br />

the City for a confidential review and such information shall be re<br />

turned to theApplicant and a summaryor evaluafion ofthe information<br />

shall be provided to the Commission without disclosure ofthe specific<br />

personal or proprietary information<br />

The Commission shall act upon an application of Certificate ofEco<br />

nomic Hardship within a<br />

period not to exceed six 6 months from the<br />

original date ofthe denial ofa Certificate of Appropriateness Ifno ac<br />

tion has been taken by the Commission withinthis six6 month period<br />

the applicafion shall be deemed granted unless the time is extended<br />

upon by mutual agreement Upon the denial of an application the ap<br />

plicant shall be notifiedbymail<br />

Demolition or removal ofa principal structure on acommercial prop<br />

erty s ina designated HPD or HPshall comply with the regulations set<br />

forth within thisChapter andthose in Section 1133 08<br />

Demolition or removal of aprincipal structure on a residential prop<br />

erty s in a designated HPD or HP shall comply with the regulations set<br />

forth withinthis Chapter andthose in Section 1133 09<br />

1134 09 RESCISSION <strong>OF</strong>A DESIGNATION OR DETERMINA<br />

TION<br />

Notwithstanding any provision ofthis Chapter to the contrary the Commission<br />

may rescind the designation or determination of any azea place building or<br />

structure work ofart or other object as a I3PD orHP by majority vote by finding<br />

that the designated HPD or HD does not meet the designation criteria or to pro<br />

tect the public interest in response to<br />

changed circumstances since the designa<br />

fion decision was made This rescission act ofthe Commission shall relieve the<br />

owner ofsuch property from any duties or<br />

penalties<br />
