ORDINANCE NO 85 09 BY<br />
AN ORDINANCE to take effect immediately provided it receives the affirmative vote of<br />
atleast five 5 members elected to Council otherwise it shall take effect andbe in force after the<br />
earliest period aLd ved by law amending Ordinance Ob adapted 3uly 2006 toatnerid<br />
section 902 04 Rates and Charges of the Codified Ordinances of the City of Lakewood for the<br />
purpose of adjusting sewer rates bhazged against each lot parcel ofland or premises which may<br />
have an active sewer connection with the Municipal wastewater disposal system or which may<br />
otherwise discharge wastewatereither directly or indirectly into such system or any part thereof<br />
WHEREAS the current sewer rate is insufficient to allow the Wastewater Treatment<br />
Fund and Wastewater Collections System Fund to continue to beself supporting and<br />
WHEREAS in order to offset the continuing general increases in capital costs of the<br />
wastewater collections and treatment facilities it is necessary for the City to increase the rates<br />
charged to the users of the wastewater disposal system as well as provide for the anticipated<br />
annual capital needs for thewastewater collectionand treatment system and<br />
WHEREAS Chapter 902 of the Codified Ordinances authorizes the City to set sewer<br />
rates to distribute the costs of operation and maintenance ofthe wastewater disposal system and<br />
the costs to maintain compliance with applicable standards and regulations of theUSEPA<br />
proportionately upon all users ofsaid system<br />
Now therefore<br />
BE IT ORDAINED BY <strong>THE</strong> <strong>CITY</strong> <strong>OF</strong> <strong>LAKEWOOD</strong> STATE <strong>OF</strong> OHIO<br />
Secfion 1 That Section 902 04 Rates and Charges of the Codified Ordinances of the<br />
City ofLakewood currently reads asfollows<br />
902 04 RATES AND CHARGES<br />
a The Director ofPublic Works is hereby authorized to<br />
annually establish sewer rates<br />
charged by the Lakewood Division of Water and Wastewater Collections and the<br />
LakewoodDivision ofWastewater Treatment<br />
1 Such charges and rates shall be made against each lot parcel of land or<br />
premises<br />
which may have an active sewer connection with the Municipal wastewater<br />
disposal system or which may otherwise discharge wastewater either directly or<br />
indirectly into such system or anypart thereof<br />
2 Such charges and rates shall be based on alI water used during each one month<br />
billing period<br />
3 Suchrates shall be chazged monthly<br />
