Ifno action has been taken by the Architectural Review Board or the<br />

An applicant who has been denied a Certificate of Appropriateness<br />

may within thirty 30 days ofthe denial apply for a finding<br />

of eco<br />

nomic hardship Such an application shall be made ona form prepared<br />

by the Commission The Commission may holdapublic hearing on the<br />

hazdship application<br />

All ofthe following criteria shall be considered to determine the exis<br />

tence ofan economic hardship<br />

1 Denial ofa Certificate will result in a substantial reduction in<br />

the economic value ofthe property<br />

2 Denial of a Certificate will result in a substantial economic<br />

burden on the applicant because the applicant caanot reasona<br />

blymaintain the property in its current form<br />

3 No reasonable alternative exists consistent with the architec<br />

tural standazdsandguidelines for the property<br />

4 The owner has been unable to sell the property utilizing best<br />

efforts<br />

5 Previous alterations have interfered withthe<br />

azchitectural cha<br />

racter ofthe HPD or HP andthe character defming features to<br />

illustrate the style or type aze lost and to return the HPD or<br />

HP to its original chaacter is not reasonable<br />

6 Ifthe owner is anot for profit organization and it is finan<br />

cially or physically infeasible to achieve its charitable purpose<br />

while conforming to the pertinent azchitectural stanaards and<br />

guidelines<br />

7 A court of competent jurisdicfion has required the owner to<br />

abate any iolation of these ordinances within a time frame<br />

that does not comportwith the requirementsofthis Chapter<br />

c<br />

In considering an application for a finding of economic hardship the<br />

Commission may solicit expert testimony or request thatthe applicant<br />

submit evidence concerning property value cost estimates income ex<br />
