mission within this period the applicafion shall bedeemed granted un<br />

Demolition or removal ofa principal structure on a commercial prop<br />

erty s in a designated HPD or HP shall comply with the regulations set<br />

forth withinthis Chapter<br />

and those in Section 1133 08<br />

erty s in a designated HPD or FIP shall comply with the regulations set<br />

1134 09 RESCISSION <strong>OF</strong> ADESIGNATION ORDETERMINA<br />

TION<br />

Notwithstanding any provision ofthis Chapter to the contrary the Commission<br />

may rescind the designation or determinafion of any area place building public<br />

interior portion of a building or structure work of art or other object as an HPD<br />

or HP by majority vote by finding of one or more ofthe followings a thatthe<br />

desTgnatadllPZ7 or IID does not meet the designation criteria or to protect the<br />

public interest in response to changed circumstances since the designation deci<br />

sion was madeb prejudicial procedural error inthe designation process or c<br />

professional or clerical error inthe designation This rescission act ofthe Com<br />

missionshall relievethe owner ofsuch property from any duties or penalties<br />

1134 10 EXCLUSIONS<br />

ifthe forthwith demolition ofa structure is required by an action au<br />

thorized by the Public Safety Director oftle Ciy to protect the public<br />

health orsafety saidaction shall take precedence over the provisions of<br />

this Chapter<br />

li Nothing inthis Chapter shall be construed to prevent the correction of<br />

any deterioration or damage to an azea place buIlding public interior<br />

portion of a building structure work ofart or other object and restora<br />

bon to its condition prior to such deterioration or damage<br />
