CHAPTER 5PAYMENTS AND CAPITAL MOVEMENTSARTICLE 28Payments for Current TransactionsSubject to the provisions of Article 30, the Parties undertake to allow allpayments for current transactions to be made in a freely convertible currency.ARTICLE 29Capital Movements1. The Parties shall ensure that capital for investments made in companies formedin accordance with their respective laws, any returns stemming therefrom, and theamounts resulting from liquidations of investments are freely transferable.2. The Parties shall hold consultations with a view to facilitating the movement ofcapital between the EFTA States and Serbia and achieve its complete liberalisation assoon as conditions permit.ARTICLE 30Balance of Payments DifficultiesWhere an EFTA State or Serbia is in serious balance of payments difficulties, orunder threat thereof, the EFTA State concerned or Serbia, respectively, may, inconformity with the conditions laid down within the framework of the GATT and inArticles VIII and XIV of the Statutes of the International Monetary Fund, takerestrictive measures with regard to current payments if such measures are strictlynecessary. The EFTA State concerned or Serbia, as the case may be, shall inform theother Parties immediately of such measures and shall provide as soon as possible atimetable for their removal.XVII
ARTICLE 31ClarificationsIt is understood that the obligations stated in this Chapter are without prejudiceto the equitable, non-discriminatory and good faith application of measures pursuant tocourt orders or judgements and administrative proceedings. It is also understood that theright of an investor to freely transfer amounts in relation to his investment is withoutprejudice to any fiscal obligation such an investor may have.XVIII
