ANNEX VIIREGARDING TRANSITIONAL RULES COVERING CERTAIN ARTICLES OFTHE FREE TRADE AGREEMENT BETWEENTHE EFTA STATES AND THE REPUBLIC OF SERBIAConsidering that Articles 12 (Sanitary <strong>and</strong> Phytosanitary Measures), 13(Technical Regulations), 17 (Subsidies <strong>and</strong> Countervailing Measures), <strong>and</strong> 18 (Antidumping)refer to <strong>the</strong> respective Agreements <strong>of</strong> <strong>the</strong> World Trade Organization(hereinafter <strong>the</strong> “WTO”) without incorporating <strong>the</strong>m into this Agreement,The Parties agree that until Serbia becomes a full Member <strong>of</strong> <strong>the</strong> WTO:(a)(b)(c)<strong>the</strong> WTO Agreement on <strong>the</strong> Application <strong>of</strong> Sanitary <strong>and</strong> PhytosanitaryMeasures, <strong>the</strong> WTO Agreement on Technical Barriers to Trade, ArticlesVI <strong>and</strong> XVI <strong>of</strong> <strong>the</strong> GATT 1994, <strong>and</strong> <strong>the</strong> WTO Agreement on Subsidies<strong>and</strong> Countervailing Measures shall be considered to be part <strong>of</strong> <strong>the</strong> FreeTrade Agreement <strong>and</strong> apply, mutatis mut<strong>and</strong>is, to <strong>the</strong> Parties;<strong>the</strong> application <strong>of</strong> Article 36 (Non-Application) <strong>of</strong> <strong>the</strong> Free TradeAgreement shall be suspended; <strong>and</strong>Serbia shall not apply anti-dumping measures in relation to productsoriginating in ano<strong>the</strong>r Party.________________
