INVENTIONS IN OUTER SPACE (Public Law 101-580 [S. 459]; November 15, 1990)An Act to amend title 35, United States Code, with respect to the use of inventions in outer space.Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,SECTION 1. INVENTIONS IN OUTER SPACE.(a) In General.—Chapter 10 of title 35, United States Code, is amended by adding at the end the following:"§ 105. Inventions in outer space"(a) Any invention made, used or sold in outer space on a space object or component thereof under the jurisdiction orcontrol of the United States shall be considered to be made, used or sold within the United States for the purposes ofthis title, except with respect to any space object or component thereof that is specifically identified and otherwiseprovided for by an international agreement to which the United States is a party, or with respect to any space object orcomponent thereof that is carried on the registry of a foreign state in accordance with the Convention on Registrationof Objects Launched into Outer Space."(b) Any invention made, used or sold in outer space on a space object or component thereof that is carried on the registryof a foreign state in accordance with the Convention on Registration of Objects Launched into Outer Space, shall beconsidered to be made, used or sold within the United States for the purposes of this title if specifically so agreed inan international agreement between the United States and the state of registry.".
Commentary on Emerging System of Property Rights in OuterSpaceSetsuko AokiAssociate Professor, Faculty of Policy Management,Keio University, Japan______________________________________________________________________________IntroductionAfter a most comprehensive and well documented presentation by Prof. Hongkyun Shin,I am not sure if I can add any further comment. Since Prof. Shin made a presentation with theemphasis on the theoretical aspects of property rights, I am going to comment from the concretepoints of view.I would like to refer to several points in this commentary paper. First, based on myinterpretation of Article II of the Outer Space Treaty, the scope of non-appropriation will beconsidered. I am of the opinion that the scope of non-appropriation extends to non-governmentalentities. However, aside from non-appropriation of territorial title, little is expressly decided inthe Outer Space Treaty. Thus, next, I would underline that the regime on property rights in outerspace should be set up before the exploitation of resources becomes a reality. In that regard,analogy with, and/or reference to recent developments in the international law of the sea seems tobe a good starting point. Finally, as Prof. Shin enumerated the exclusive rights to use outer space,I would also reiterate the importance of constructing rules on exclusive rights for the equitableuse of outer space as a global commons. Some examples in the field of space telecommunicationswill be introduced as an exercise of exclusive rights that could cause awkward problems to theexisting legal regime.I. Legal Status of Outer SpaceArticle II of the Treaty on Principles Governing the Activities of States in the Explorationand Use of Outer Space, including the Moon and Other Celestial Bodies (Outer Space Treaty, orOST) provides:“Outer Space, including the Moon and other celestial bodies, is not subject tonational appropriation by claim of sovereignty, by means of use or occupation, orby any other means”.The rule is clear among the contracting States of this treaty: territorial title in outer spaceor on celestial bodies cannot be claimed by way of occupation or any other means. Then, majorquestions concerning this provision would be whether such a rule would be also binding uponnon-Parties to the Outer Space Treaty as customary international law and upon private persons instate parties to the Treaty.
