INVENTIONS IN OUTER SPACE (Public Law 101-580 [S. 459]; November 15, 1990)An Act to amend title 35, <strong>United</strong> States Code, with respect to <strong>the</strong> use <strong>of</strong> inventions in outer space.Be it enacted by <strong>the</strong> Senate and House <strong>of</strong> Representatives <strong>of</strong> <strong>the</strong> <strong>United</strong> States <strong>of</strong> America in Congress assembled,SECTION 1. INVENTIONS IN OUTER SPACE.(a) In General.—Chapter 10 <strong>of</strong> title 35, <strong>United</strong> States Code, is amended by adding at <strong>the</strong> end <strong>the</strong> following:"§ 105. Inventions in outer space"(a) Any invention made, used or sold in outer space on a space object or component <strong>the</strong>re<strong>of</strong> under <strong>the</strong> jurisdiction orcontrol <strong>of</strong> <strong>the</strong> <strong>United</strong> States shall be considered to be made, used or sold within <strong>the</strong> <strong>United</strong> States <strong>for</strong> <strong>the</strong> purposes <strong>of</strong>this title, except with respect to any space object or component <strong>the</strong>re<strong>of</strong> that is specifically identified and o<strong>the</strong>rwiseprovided <strong>for</strong> by an international agreement to which <strong>the</strong> <strong>United</strong> States is a party, or with respect to any space object orcomponent <strong>the</strong>re<strong>of</strong> that is carried on <strong>the</strong> registry <strong>of</strong> a <strong>for</strong>eign state in accordance with <strong>the</strong> Convention on Registration<strong>of</strong> Objects Launched into <strong>Outer</strong> Space."(b) Any invention made, used or sold in outer space on a space object or component <strong>the</strong>re<strong>of</strong> that is carried on <strong>the</strong> registry<strong>of</strong> a <strong>for</strong>eign state in accordance with <strong>the</strong> Convention on Registration <strong>of</strong> Objects Launched into <strong>Outer</strong> Space, shall beconsidered to be made, used or sold within <strong>the</strong> <strong>United</strong> States <strong>for</strong> <strong>the</strong> purposes <strong>of</strong> this title if specifically so agreed inan international agreement between <strong>the</strong> <strong>United</strong> States and <strong>the</strong> state <strong>of</strong> registry.".
