Development <strong>of</strong> Liability ConventionBeing discussed since 1958Proposed by US in 1962 during <strong>the</strong> 1st meeting <strong>of</strong> UNCOPUOS Legal Sub-committee. Adopted in 1972Referring to Art. VII <strong>of</strong> OST“… internationally liable <strong>for</strong> damage to ano<strong>the</strong>r State Party to <strong>the</strong> Treaty…”4 essential elements proposed by US:1. An explicit rule that <strong>the</strong> demonstration <strong>of</strong> fault cannot be a requirement <strong>of</strong> orprerequisite to liability2. The standards to be applied to evaluate <strong>the</strong> damage suffered and a<strong>the</strong> appropriatecompensation payable3. A denial <strong>of</strong> <strong>the</strong> traditional requirement <strong>for</strong> <strong>the</strong> claimant to exhaust eall appropriatelocal remedies4. The imposition <strong>of</strong> specific time limits on negotiation <strong>for</strong> settlements tlements and <strong>the</strong>establishment <strong>of</strong> impartial claims commission to “advise” <strong>the</strong> parties
