Lack of F<strong>in</strong>al Settlement of Claims:In most PAs <strong>in</strong> <strong>Orissa</strong>, the settlement of claims and rights as laid down <strong>in</strong> Sections 19-26A of WL Act, 1972 hasn’t taken place. Only one PA has been f<strong>in</strong>ally notified. All theother PAs are at different stages of notifications. However, the WildlifeAdm<strong>in</strong>istration, tak<strong>in</strong>g the plea of the provision on <strong>in</strong>tention of declaration ofprotected area lead<strong>in</strong>g to suspension of rights even <strong>in</strong> case of non-completion ofproceed<strong>in</strong>gs of determ<strong>in</strong>ation and acquisition of rights [Section 25 A of Wildlife(Amendment) Act, 2002], has clamped down on the people liv<strong>in</strong>g <strong>in</strong>side theboundaries of the PAs. This perversion of natural justice is aga<strong>in</strong>st the spirit of law aswell as constitution, as many of these processes of settlement have been pend<strong>in</strong>g formore than a decade.These deficiencies need to be <strong>in</strong>vestigated and used to challenge the State’s promotionof an exclusionary conservation model. One of the most serious livelihood issues haveemerged from the ban on NTFP collection <strong>in</strong> PAs as per the Supreme Court orderdated 14th February 2000(WP No. 202/95).8. Issues of Forest Villages:In many protected areas forest department itself established forest villages. The ma<strong>in</strong>objective beh<strong>in</strong>d establish<strong>in</strong>g these villages was to ensure availability of labour forcarry<strong>in</strong>g out various forestry works such as forest l<strong>in</strong>e demarcation, ext<strong>in</strong>guish<strong>in</strong>gforest fires, construction of forest roads etc. forest department allotted land to thesevillagers at that time for homestead and agriculture for meet<strong>in</strong>g their subsistenceneeds. But till now these villages are not converted <strong>in</strong> to revenue villages.9.
