Issue of Right Settlement:After declaration of intention forconstituting an area as sanctuary u/s 18 Hearing Meetingsof WLP Act, 1972, the sections from 19 Total No. Venue of Dateof Villages hearingto 26A describes various the procedures 9 villages Jamudoli 8 th May 1998for settling the rights of local 9 villages Tikarpada 15 th May 19989 villages Purunakot 22 nd May 1998inhabitants. In case of Satkosiya8 villages Jaganathpur 29 th May 1998Wildlife Santuary, the collector ofAngul district issued Form No. 8 on 12 thSeptember 1997 u/s of 26 of the ‘The wildlife (Protection) (Orissa) Rules, 1974’due to the Hon’ble Supreme Courts’ direction in a Writ Petition (Civil) No.337/95. Further in 23 rd April 1998, the concern district collector issued notice toeach village headman u/s of 27 of the ‘The Wildlife (Protection) (Orissa) Rules,1974’ to attend public hearing. The District Collector, Angul organized fourpublic hearings in the month of May 1998 at different places (see the box) andfinally submitted the report to the state government on 24 th July 1998 andrecommended for issuance of final notification u/s 26 of WLP Act 1972. Therecommendations of the district collector are as follows:1. Total deletion of 9 (nine) villages of Athmallick Sub –Division,measuring Ac. 2458.82 from the Sanctuary area.2. Exclusion of Ac. 12701.19 from the sanctuary i.e. total area of 20 villagesof Angul sub-Division.3. Exclusion of Ac. 534.69 from the sanctuary, being the area of three forestvillages that are to be declared as revenue villages.4. Acquisition of Ac.162.28 of land in village Raigoda, through LandAcquisition proceedings for shifting of the village to a new site withrehabilitation benefits as per norms of Water Resources Rehabilitation& Resettlement Plan.5. Since I am recommending for exclusion of Ac. 15694.70 area from thesanctuary equal or more extent of reserve forest area adjacent to the92
sanctuary having no human habitation may be included in thesanctuary.During discussion with the local people and representatives of Praja SurakhyaSamiti in regards to the right settlement the following things they put forthbefore us:• “Land settlement was not carried out after 1962. During these period thestatus and ownership of land already changed. Without fresh survey &settlement district collector hold hearing meetings. We have put theissue before the district collector even we gave in written but nothinghappened.”• According to the section 21 of WLP Act 1972, the collector has to publishnotice in the local language and serve to the each family. Instead ofpublishing it in Oriya language, they served the Form No. 8 in English.The villagers stated that we put forth the issue before the collector priorto the hearing meeting but nothing happened and instead of giving thenotice to the families he issued notice in the name of the villageheadman.• There is no detailed procedure laid down either in the provisions ofWLP Act, 1972 or in ‘The Wildlife (Protection) (Orissa) Rules, 1974’ inregards to the settlement of rights. As it empowers the collector todecide so the collector of Angul district decided to hold hearingmeetings at four places taking into 8 villages per hearing. Is it possibleto hear all families’ claims within 3 to 4 hours? It seems the wholeprocedure was carried out to legitimize the wrong processes carried outearlier for settlement of rights in the name of public hearing.• District collector did not talk about the customary rights or naturalrights i.e. right to collect, process & sell of NTFPs, even in the Form No.8, nothing was mentioned in this regard.
