General Orders of the Turks and Caicos Islands Public Service - 1998 EditionCHAPTER 8LEAVEOrder 8.1Leave8.1.1 All leave is granted subject to the exigencies of the Public Service and at the discretion of theapproving authority. Leave is not a right.8.1.2 Leave falls into four categories:annual leave which is earned by locally appointed Officers;vacation leave which is earned by Overseas Officers in accordancewith their Contracts of service and taken in the course of or following a tour of residentialservice;local leave which Overseas Officers (except teachers) may take of five Working Days ineach twelve months of resident service, which may not be accumulated, and may not to betaken within three months of their residential service starting nor three months of their tourending, and may not be taken in conjunction with vacation leave in the course of a tour; andoccasional leave of seven Working Days a year may be granted to locally appointedOfficers against which occasional absences from duty may be charged at not more than twodays at a time. This leave is intended to cater for an Officer's occasional requirement to taketime off for personal business during Normal Working Hours.8.1.3 Officers serving as teachers are deemed to have taken and exhausted their total leaveentitlements during the school vacations as determined by the Director of Education from time to time.8.1.4 Responsible Officers are authorised to grant leave to Officers under their control. All suchleave must be reported at least one month in advance to the Chief Secretary and Chief Accountant onthe form prescribed in Appendix E. Sufficient time must be allowed for the recruitment of replacementOfficers where applicable.8.1.5 All leave of Department Heads and Permanent Secretaries must be approved by the ChiefSecretary. All such leave must be reported to the Chief Secretary and Chief Accountant on the formprescribed in Appendix-E.8.1.6 As a general rule it is a condition of granting leave that the duties of the Officer on leave willbe satisfactorily performed in his or her absence and that no additional costs will arise as a result ofthat leave that is not provided for in the Annual Estimates.8.1.7 Leave earned will be computed in Working Days and will commence from the Working Dayafter an Officer has handed over his or her duties and end on the Working Day preceding that on whichhe or she would normally resume duty.8.1.8 Any leave granted under these Orders may by the authority empowered to grant leave becancelled if it is desirable that an Officer should return to duty before the expiry of the leave granted,provided that the unexpired portion of the leave may be taken on a subsequent occasion.8.1.19 An Officer seeking an extension of leave must in the absence of exceptional circumstancesapply to his or her Department Head (or Permanent Secretary or Chief Secretary) in sufficient time for32
General Orders of the Turks and Caicos Islands Public Service - 1998 Editiona decision on the application to be taken and communicated to him or her before the expiry of the leavegranted.8.1.10 If an Officer on leave becomes sick whilst on leave, whether medically certified or not, thenthis shall not be reason to extend any leave and if the Officer remains sick after the expiry of the periodof authorised leave then this period shall be treated as sick leave under these Orders. Sickness during aperiod of authorised leave shall count as part of that leave and not as sick leave under these Orders justas sickness on any other non-Working Day does not entitle an Officer to another day off from work inlieu.8.1.11 An Officer may be required by the Chief Secretary to take leave which is due to him or her andan Officer may be required in the public interest and at the discretion of the Chief Secretary to remainon leave after the expiry of the leave granted or required of him or her.8.1.12 Where an Officer is granted more leave than the maximum for which he or she is eligible (withthe exception of teachers taking leave during the authorised school vacations) he or she may either:00have the excess leave taken deducted from the amount of leave due in the next leave year, or if his isnot possible,be required to refund salary in respect of the days of excess taken and have the days counted as leavewithout pay for the purposes of pension or gratuity.8.1.13 The rates of annual leave for which the various grades of Officers are eligible are set out inAppendix F.8.1.14 The leave year for all Officers eligible for annual leave runs from I January to 31 December ineach year. Subject to the provisions of these Orders annual leave is taken in the year in which it isaccumulated and is itself leave earning.9.1.15 Where an Officer is not, nor is it anticipated that he or she will be, in Government employmentfor a full calendar year the Officer's annual leave will be assessed proportionately by reference to thenumber of completed months of service in the calendar year.8.1.16 No Officer is eligible for annual leave in his or her first six months of service.8.1.17 At least one-half of annual leave must be taken in the year in which it is earned and any balanceup to a maximum of thirty days may be accumulated. After the maximum accumulation is reachedannual leave not taken will be forfeited. An Officer who on the date of coming into force of theseOrders had annual leave in excess of thirty days' accumulation will be required to take such excess ininstalments within five years. Any remaining part of that unused accumulation will be held over untilretirement. The Chief Secretary may in exceptional circumstances where an Officer has been preventedby the exigencies of the public Service from taking animal leave, direct that the leave may beaccumulated and not count towards the limit of thirty days imposed above.8.1.18 Responsible Officers are responsible for the proper maintenance of leave records in respect ofall Officers under their control and for notifying the Establishment Secretary, on the form given atAppendix E, who will maintain a central record.33
