General Orders of the Turks and Caicos Islands Public Service - 1998 Edition2.6.4 At this time they will cease to be covered by these Orders and their terms and conditions ofemployment will be determined by any contract of employment that may be agreed between the personand the employing authority. They will become entitled to the benefits and payments that wouldordinarily be due to them had they satisfactorily ended their employment with the Public Service at thistime.Order 2.7Probation2.7.1 All permanent Appointments will be on Probationary terms. These terms require that an Officerwill serve a Probationary period of two years on initial Appointnwnt to the Public Service and twelvemonths for appointments other than initial Appointments.2.7.2 At the end of the first twelve months of a two year Probationary period and at the end of thefirst six months of a twelve month Probationary period, Responsible Officers shall submit to the ChiefSecretary a report on every Officer appointed on Probation.2.7.3 One month before the end of the Probationary period the Responsible Officer shall submit areport to the Chief Secretary and recommend one of the following:that the Officer be confirmed in the Appointment;that the Probationary period be extended;that the Officer's service be terminated, (for initial Appointments only);that the Officer revert to his or her former post.2.7.4 Before any recommendation is made for the extension of a period of Probation of an Officer orfor the termination of his or her Appointment, the Responsible Officer shall inform the Officer of hisor her recommendations and of the specific reasons therefore and he or she shall invite the Officer tosubmit any representations he or she may wish to make.2.7.5 If, after considering the final report of the Responsible Officer the Chief Secretary is satisfiedthat the service of an Officer on Probation has been satisfactory, the Chief Secretary shall confirm hisor her Appointment with effect from the date of Appointment. If the Chief Secretary is not satisfiedthat the service of an Officer on Probation has been satisfactory, she may extend the period ofProbation for a further period subject to these provisions regarding Probationary periods, theAppointment on Probation of an Officer may, at any time during the period of Probation and withoutany reason being given, be terminated by the Chief Secretary.2.7.6 Where the period of Probation of an Officer has been extended and he or she is subsequentlyconfirmed in his or her Appointment, the Chief Secretary may, subject to entitlement under the rules ofthe grade and salary structure given at Appendix C, approve payment of the Officer's increment:With effect fropi, the date it was due had this period of Probation not been extended; ortwelve months after the date it was due.2.7.7 When an Officer is appointed to a Pensionable Office after NonPensionable service in anOffice in which he or she has been performing, the same or similar duties, the period of his or herProbation in the Pensionable Office may be reduced by the length of his or her Non-Pensionableservice, provided that there is no break hemeen his or her Non-Pensionable and Pensionable service.8
General Orders of the Turks and Caicos Islands Public Service - 1998 EditionOrder 2.3Transfer2.8.1 All Officers are liable for transfer to any post of equivalent grade in the Islands. Additionally,all Officers are appointed on the understanding that they may be required to serve in any duty postwithin their own cadre within the Islands. An Officer who wishes to be considered for a transfer toanother Ministry shall submit his or her application to the Chief Secretary through his or herresponsible Officer who shall forward it with his or her comments within five Working days.2.8.2 Subject to the other provisions of these Orders a transfer of an Officer not involving any changein emoluments or grading may be made:by the Pennanent Secretary if the transfer is within his or her Ministry andany Department of that Ministry;Department Head if the transfer is within a Department orOffice; orby the Chief Secretary if the transfer is between Ministries.Order 2.9Contracts2.9.1 Appointments on Contract terms will be in accordance with the applicable form of Contract asdetermined by the Chief Secretary from time to time.2.9.2 Subject to Order 2.9.8 where an Officer is recruited the Contract may be for any number ofmonths with a minimum of twelve months and gratuities will only be payable on satisfactorycompletion of the agreement except as may otherwise be agreed in a contract regulated by otherauthorities.2.9.3 Overseas Officers may not be offered Contracts for less than twelve months residential servicesave for teachers who may be engaged on Contracts of not less than one academic year. Contracts ofteachers will normally be for a period of twenty one to twenty four months and Contracts of Officersother than teachers will normally be for twenty four months of residential service. Contracts for morethan one tour may be offered and exceptionally for periods between twelve and twenty one months.2.9.4 Contracts of Overseas Officers who are teachers will wherever possible be arranged so that ateacher proceeds on terminal leave at the start of the long school vacation.2.9.5 The Government's standard form of Contract is arranged so that the Officer shall give sixmonths' notice whether he or she wishes to continue in the service of the Government and it is upon theGovernment to decide whether it will offer further employment on terms to be mutually agreed. Whereno such notice is given it is assumed that the Officer does not wish to re-engage and recruitmentprocedures to fill the ensuing vacancy will be instituted.2.9.6 When the Officer wishes to re-engage and the employing Officer or Ministry supports theapplication then the responsible Officer shall then proceed in sawdance with the procedure, for fillingvacant posts.2.9.7 When the contract of an Officer wishing to re-engage is not to be renewed should be advised bythe responsible Officer at as early a date as possible.9
