General Orders of the Turks and Caicos Islands Public Service - 1998 Edition8.119 The Chief Secretary must be notified of responsible Officers who intend to spend their leave orpart of their leave overseas on the form given at Appendix E. Such notification should be made well inadvance of the date on which the leave would commence.8.1.20 Officers proceeding on leave away from their home address notified to and kept at the ChiefSecretary's Office shall notify the Chief Secretary of their address whilst on leave on the form given atAppendix E.8.1.21 An Officer applying for leave with the intention of retiring may be granted, immediately priorto the effective date of his or her retirement on pension, the accumulated leave for which he or she maybe eligible together with any additional full pay leave accumulated in accordance with Order 8.1.18,provided that without the authority of the Chief Secretary no Officer shall be granted a total period ofmore than twelve months leave prior to his or her retirement.8.1.22 An Officer who has served for not less than six months and resigns his or her Appointmentafter giving the prescribed notice or because of ill health will be granted the accumulated leave forwhich he or she is eligible provided that:the leave shall not be included as part of the period of notice of termination of service; andany Officer who, while on duty, resigns and fails to give the requisite period of notice orwho pays salary in lieu of notice, will forfeit any leave for which he or she may be eligible.8.1.23 If any Officer retires or resigns during his or her leave without having given notice of his or herdesire to do so, the date at which payment of his or her salary is to cease will be determined by the(Thief Secretary according to the circumstances of the case.9.1.24 An Officx;r who is dismissed, or has served for less than six months, or is discharged formisconduct or leaves for any reason other than following acceptance by Government of due notice willforfeit any leave for which he or she may be eligible.8.1.25 An Officer who absents himself from his station or his duties without leave, or who, without anacceptable excuse, fails to res,ime duty when he is due to do so, will be regarded as absent withoutpermission and will not be entitled to salary during such absence. All such absences will be reported tothe Chief Secretary and the period of absence may not be set off against any leave eligibility withoutthe approval of the Chief Secretary.Order 8.2Sickness leave8.2.1 An Officer may be granted sick leave if he or she is ill or injured, provided that the illness orinjury prevents him or her from carrying out his or her duties and was not caused by his or her ownmisconduct or negligence.8.2.2 Sick leave over and above absences of one Working lay on full pay to cover absences fromduty due to illness or injury shall be granted by Responsible Officers on the written recommendationof a Government Medical Practitioner. Sick leave of one Working Day or less on full pay may begranted by Responsible Officers without reference to a Government Medical Practitioner. An Officerwho is absent through illness should report to a Government Medical Practitioner within 24 hours ofabsenting himself or herself to obtain a certificate to the effect that the absence is justified through illhealth.34
General Orders of the Turks and Caicos Islands Public Service - 1998 Edition8.2.3 Medical certificates covering sickness absence should be retained by the Responsible Officersfor record keeping purposes and the Responsible Officer should notify the Chief Secretary of allsickness absences as they occur, for central record keeping purposes, using the form given in AppendixE.8.2.4 The Chief Secretary may require at any time for an Officer to be examined by the ChiefMedical Officer in respect of that Officer's illness or injury and his or her ability to satisfactorilyperform his or her normal duties.8.2.5 Sick leave in excess of the limits set out in these Orders will only be Wmnted by and at thediscretion of the Chief Secretary acting upon the advice of the Chief Medical Officer.8.2.6 An Officer who is established and on Pensionable terms may be granted sick leave on fullsalary up to a maximum period of six months in any period of twelve months. Thereafter if necessarythe entitlement is for a further six months in that same twelve month period on half salary. Exceptwhere an Officer has accumulated leave in which case this leave must be taken and exhausted beforethe entitlement to half pay commences. Sick leave beyond an aggregate of twelve months in any periodof four years or less will be without salary and will not count as service for salary increments orpension, but in this event Medical Board procedures should be invoked.8.2.7 Officers appointed on non-Pensionable terms or who are not established may be granted sickleave on full salary up to a maximum period of three months during any period of twelve months. Anyextension of sick leave will be without salary and will not count as service for salary increments orgratuity.8.2.8 An Officer who has been on sick leave for a continuous period of three months, or who hasbeen sporadically absent through sickness for a total period of three months in any twelve monthperiod will, at the discretion of the Chief Secretary, be required to submit for an examination orrepeated examination by a Medical Board appointed by the Chief Medical Officer.8.2.9 If a Medical Board advises that it is unlikely that an Officer will be likely to return to duty inthe foreseeable future, or regain and maintain more regular pattern of attendance at work withsatisfactory performance, the Chief Secretary will make a decision upon the recommendation of theMedical Board as to the Officer's continuing suitability for employment. If the Chief Secretary is of theopinion that the Appointment of the Officer should be terminated she shall notify the Commissionaccordingly and the procedure described in Part III of the Public Service (Appointment, Removal andDiscipline of Public Officers) Rules contained in the Schedule to the Public Service (Delegation ofPowers) Regulations 1997 shall apply8.2.10 An Officer must seek qualified medical advice when he or she is unwell or when instructed todo so by his or her Responsible Officer. If he or she fails to do so or fails to comply with the medicaladvice given he or she may render himself or herself liable to disciplinary action.8.2.11 If for any reason it is decided that an Officer should be examined by a Medical Board, he or shemust present himself or herself at the place and time instructed and if they fail to do so will renderhimself or herself liable for disciplinary action.8.2.12 The Governor, in his discretion, may grant sick leave on full pay in addition to a period of sickleave on full pay provided under these Orders where, in his opinion, any Officer is suffering from35
