<strong>General</strong> <strong>Orders</strong> <strong>of</strong> <strong>the</strong> <strong>Turks</strong> <strong>and</strong> <strong>Caicos</strong> Isl<strong>and</strong>s <strong>Public</strong> <strong>Service</strong> - 1998 Edition8.4.5 Where a course <strong>of</strong> study for which <strong>the</strong> Officer would be suited <strong>and</strong> that would lead to aqualification that is needed by <strong>the</strong> Officer to perform in <strong>the</strong> <strong>Public</strong> <strong>Service</strong>, <strong>the</strong>n study leave may begranted on application to <strong>the</strong> Chief Secretary to an Officer who:is nominated to attend <strong>the</strong> course <strong>of</strong> study; wishes to attend <strong>the</strong> course <strong>of</strong> study; <strong>and</strong>is granted a bursary or scholarship or o<strong>the</strong>r award to follow <strong>the</strong> course <strong>of</strong> study.8.4.6 If <strong>the</strong> course <strong>of</strong> study for which study leave is granted is held in <strong>the</strong> Isl<strong>and</strong>s or if it is heldoutside <strong>the</strong> Isl<strong>and</strong>s <strong>and</strong> its duration is less than ninety days <strong>the</strong>n <strong>the</strong> Officer will be regarded as if he orshe were on duty. If <strong>the</strong> period <strong>of</strong> <strong>the</strong> course is more than ninety days <strong>the</strong> Officer will be required toutilise one half <strong>of</strong> <strong>the</strong> leave for which he or she is eligible <strong>and</strong> will be granted study leave on full payfor <strong>the</strong> balance <strong>of</strong> <strong>the</strong> course.8.4.7 An Officer who receives a bursary or o<strong>the</strong>r award to attend a course <strong>of</strong> study or is o<strong>the</strong>rwiseaccepted for admission to a course but is not required by <strong>the</strong> Chief Secretary to attend <strong>the</strong> course mayapply for approval from <strong>the</strong> Chief Secretary to attend <strong>the</strong> course. In such a case <strong>the</strong> Officer may begranted study leave without pay for <strong>the</strong> full period <strong>of</strong> <strong>the</strong> course but an Officer who has not beenconfirmed in his or her Appointment will have to resign <strong>the</strong> Appointment to attend <strong>the</strong> course,provided in ei<strong>the</strong>r case that <strong>the</strong> Officer may be granted <strong>the</strong> full amount <strong>of</strong> leave to which he or she iseligible.8.4.8 The grant <strong>of</strong> study leave will be subject to <strong>the</strong> execution <strong>of</strong> an agreement by <strong>the</strong> Officer toundertake to remain in <strong>the</strong> <strong>Public</strong> <strong>Service</strong> for a prescribed period after <strong>the</strong> expiry <strong>of</strong> his or her leave.The period will be one month for every two months <strong>of</strong> study leave granted with a minimum period <strong>of</strong>twelve months <strong>and</strong> a maximum period <strong>of</strong> sixty months. The agreement may take <strong>the</strong> form <strong>of</strong> a bondwith or without sureties in default <strong>of</strong> which <strong>the</strong> Officer or his or her sureties will be liable to repay to<strong>the</strong> Government all or part <strong>of</strong> any allowances, fares, fees, passages <strong>and</strong> salary paid to him or her during<strong>the</strong> period <strong>of</strong> <strong>the</strong> course as <strong>the</strong> Chief Secretary may prescribe.8.4.9 An Officer attending a course <strong>of</strong> study will be required to furnish to <strong>the</strong> Chief Secretary at suchperiods as may be prescribed, a certificate from <strong>the</strong> appropriate authority at <strong>the</strong> institution at which heor she is pursuing <strong>the</strong> course <strong>of</strong> study in pro<strong>of</strong> <strong>of</strong> his or her regular attendance, <strong>of</strong> his or her diligence<strong>and</strong> energy in his or her studies. If it is evident that <strong>the</strong> Officer has ab<strong>and</strong>oned <strong>the</strong> course or if progressis so unsatisfactory that it would be in <strong>the</strong> public interest to do so, <strong>the</strong> Chief Secretary may cancel <strong>the</strong>remaining period <strong>of</strong> study leave <strong>and</strong> instruct <strong>the</strong> Officer to return to duty.8.4.10 Where an Officer is nominated by <strong>the</strong> Chief Secretary to attend a course <strong>of</strong> study <strong>and</strong> is grantedleave for that purpose his or her tuition fees will, unless such fees are included in any bursary or awardwhich is made, be paid by <strong>the</strong> Government. Where this course <strong>of</strong> study involves an examination by arecognised body <strong>the</strong>n <strong>the</strong> Officer will be eligible for a refund <strong>of</strong> any examination fee that he or she haspaid, if he or she has passed <strong>the</strong> examination.Order 8.5Miscellaneous leave provisions8.5.1 Any leave for which an Officer may have been eligible which is outst<strong>and</strong>ing at <strong>the</strong> date <strong>of</strong> hisor her death may be commuted for cash <strong>and</strong> paid to <strong>the</strong> Officer's estate.8.5.2 Leave granted on full or half pay counts as Pensionable service <strong>and</strong> service qualifying forpension. Leave granted without pay is qualifying service <strong>and</strong> does not break continuity <strong>of</strong> Pensionableservice but it counts as Pensionable only when granted on grounds <strong>of</strong> public policy.37
