<strong>General</strong> <strong>Orders</strong> <strong>of</strong> <strong>the</strong> <strong>Turks</strong> <strong>and</strong> <strong>Caicos</strong> Isl<strong>and</strong>s <strong>Public</strong> <strong>Service</strong> - 1998 Editiona decision on <strong>the</strong> application to be taken <strong>and</strong> communicated to him or her before <strong>the</strong> expiry <strong>of</strong> <strong>the</strong> leavegranted.8.1.10 If an Officer on leave becomes sick whilst on leave, whe<strong>the</strong>r medically certified or not, <strong>the</strong>nthis shall not be reason to extend any leave <strong>and</strong> if <strong>the</strong> Officer remains sick after <strong>the</strong> expiry <strong>of</strong> <strong>the</strong> period<strong>of</strong> authorised leave <strong>the</strong>n this period shall be treated as sick leave under <strong>the</strong>se <strong>Orders</strong>. Sickness during aperiod <strong>of</strong> authorised leave shall count as part <strong>of</strong> that leave <strong>and</strong> not as sick leave under <strong>the</strong>se <strong>Orders</strong> justas sickness on any o<strong>the</strong>r non-Working Day does not entitle an Officer to ano<strong>the</strong>r day <strong>of</strong>f from work inlieu.8.1.11 An Officer may be required by <strong>the</strong> Chief Secretary to take leave which is due to him or her <strong>and</strong>an Officer may be required in <strong>the</strong> public interest <strong>and</strong> at <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> Chief Secretary to remainon leave after <strong>the</strong> expiry <strong>of</strong> <strong>the</strong> leave granted or required <strong>of</strong> him or her.8.1.12 Where an Officer is granted more leave than <strong>the</strong> maximum for which he or she is eligible (with<strong>the</strong> exception <strong>of</strong> teachers taking leave during <strong>the</strong> authorised school vacations) he or she may ei<strong>the</strong>r:00have <strong>the</strong> excess leave taken deducted from <strong>the</strong> amount <strong>of</strong> leave due in <strong>the</strong> next leave year, or if his isnot possible,be required to refund salary in respect <strong>of</strong> <strong>the</strong> days <strong>of</strong> excess taken <strong>and</strong> have <strong>the</strong> days counted as leavewithout pay for <strong>the</strong> purposes <strong>of</strong> pension or gratuity.8.1.13 The rates <strong>of</strong> annual leave for which <strong>the</strong> various grades <strong>of</strong> Officers are eligible are set out inAppendix F.8.1.14 The leave year for all Officers eligible for annual leave runs from I January to 31 December ineach year. Subject to <strong>the</strong> provisions <strong>of</strong> <strong>the</strong>se <strong>Orders</strong> annual leave is taken in <strong>the</strong> year in which it isaccumulated <strong>and</strong> is itself leave earning.9.1.15 Where an Officer is not, nor is it anticipated that he or she will be, in Government employmentfor a full calendar year <strong>the</strong> Officer's annual leave will be assessed proportionately by reference to <strong>the</strong>number <strong>of</strong> completed months <strong>of</strong> service in <strong>the</strong> calendar year.8.1.16 No Officer is eligible for annual leave in his or her first six months <strong>of</strong> service.8.1.17 At least one-half <strong>of</strong> annual leave must be taken in <strong>the</strong> year in which it is earned <strong>and</strong> any balanceup to a maximum <strong>of</strong> thirty days may be accumulated. After <strong>the</strong> maximum accumulation is reachedannual leave not taken will be forfeited. An Officer who on <strong>the</strong> date <strong>of</strong> coming into force <strong>of</strong> <strong>the</strong>se<strong>Orders</strong> had annual leave in excess <strong>of</strong> thirty days' accumulation will be required to take such excess ininstalments within five years. Any remaining part <strong>of</strong> that unused accumulation will be held over untilretirement. The Chief Secretary may in exceptional circumstances where an Officer has been preventedby <strong>the</strong> exigencies <strong>of</strong> <strong>the</strong> public <strong>Service</strong> from taking animal leave, direct that <strong>the</strong> leave may beaccumulated <strong>and</strong> not count towards <strong>the</strong> limit <strong>of</strong> thirty days imposed above.8.1.18 Responsible Officers are responsible for <strong>the</strong> proper maintenance <strong>of</strong> leave records in respect <strong>of</strong>all Officers under <strong>the</strong>ir control <strong>and</strong> for notifying <strong>the</strong> Establishment Secretary, on <strong>the</strong> form given atAppendix E, who will maintain a central record.33
