<strong>General</strong> <strong>Orders</strong> <strong>of</strong> <strong>the</strong> <strong>Turks</strong> <strong>and</strong> <strong>Caicos</strong> Isl<strong>and</strong>s <strong>Public</strong> <strong>Service</strong> - 1998 EditionCHAPTER 9RESIGNATION AND RETIREMENTSection 9.1Resignation requirements9.1.1 An Officer who has been confirmed in his or her Appointment to a Pensionable Office or anOfficer serving on Probation in a Pensionable Office may resign his or her Appointment after givingnot less than one month's notice in writing, exclusive <strong>of</strong> leave, to <strong>the</strong> Chief Secretary.9.1.2 An Officer appointed on a Contract may resign his or her Appointment only in accordance with<strong>the</strong> terms <strong>of</strong> his or her Contract or Letter <strong>of</strong> Appointment respectively.9.1.3 An Officer may instead <strong>of</strong> giving due notice resign his or her Appointment at any time afterpaying to Government one month's salary in lieu <strong>of</strong> notice. In such cases <strong>the</strong> Officer will forfeit allleave <strong>and</strong> passage privileges for which he or she might have been eligible.9.1.4 All resignations will be reported immediately to <strong>the</strong> Chief Secretary, Chief Accountant <strong>and</strong>Chief Auditor.9.1.5 No resignation is effective until it is accepted by <strong>the</strong> Chief Secretary.9.1.6 The Chief Secretary may refuse to accept notice <strong>of</strong> resignation if it is conditional or ifdisciplinary proceedings against <strong>the</strong> Officer are contemplated or pending.9.1.7 When an application for employment is received from a person who has previously resignedfrom <strong>the</strong> <strong>Public</strong> <strong>Service</strong>, <strong>the</strong> circumstances which prompted <strong>the</strong> rolien lion will be investigated before adecision is taken on <strong>the</strong> application by <strong>the</strong> Chief Secretary.Section 9.2Retirement <strong>and</strong> terminal benefits9.2.1 Pensions, gratuity <strong>and</strong> o<strong>the</strong>r retiring allowances should be calculated by <strong>the</strong> Chief Accountanton <strong>the</strong> basis <strong>of</strong> <strong>the</strong> Officer's record <strong>of</strong> service prepared by <strong>the</strong> Chief Secretary as soon as a decision hasbeen taken regarding an Officer's retirement. The form will be prepared by <strong>the</strong> Chief Accountant <strong>and</strong>submitted with all necessary supporting documents attached <strong>the</strong>reto to <strong>the</strong> Permanent Secretary(Finance) <strong>and</strong> to <strong>the</strong> Chief Auditor.9.2.2 In cases where it is not possible to locate <strong>the</strong> necessary records <strong>of</strong> an Officer's service anotarised affidavit or affidavits should be submitted by one or more reliable persons attesting to <strong>the</strong>dates <strong>and</strong> continuity <strong>of</strong> service. The status <strong>of</strong> <strong>the</strong> declarant should be stated <strong>and</strong> he or she should alsogive <strong>the</strong> source <strong>of</strong> his or her knowledge <strong>of</strong> <strong>the</strong> facts given in <strong>the</strong> affidavit.9.2.3 The Officer's birth certificate should be furnished as evidence <strong>of</strong> his or her age. Where this isnot possible a statutory declaration by <strong>the</strong> Officer or any o<strong>the</strong>r reliable person may be submitted.9.2.4 In <strong>the</strong> event <strong>of</strong> <strong>the</strong> death <strong>of</strong> a serving Officer, <strong>the</strong> Responsible Officer will be responsible forensuring that prompt application is made for any payment or gratuity that may be due.39
