Chapter 9Privacy, Service, Warranty, and Licenses156Identifiable Viewing Information, or Anonymous ViewingInformation, as defined below.a “Contact Information” means information that allowssomeone to identify or contact you, including, for example: yourname, address, telephone number, and e-mail address. ContactInformation is a subset of Account Information and is thus linkedto your TiVo DVR’s Service Number. Your ZIP code by itself,while part of your address, is not Contact Information becauseyour ZIP code alone does not allow someone to identify orcontact you. NOTE: If your TiVo DVR is receiving the TiVoBasic service, you are not required to provide TiVo with anyContact Information from that TiVo DVR.b “Service Information” means information necessary for TiVoto provide service to your TiVo DVR. Examples of ServiceInformation include your software version number, your TVprogramming source, level of service, and the success status ofthe last attempted service connection (e.g., periodic call). Thisinformation is always transmitted to TiVo when connected to theTiVo servers.1.2 “Personally Identifiable Viewing Information” meansinformation about the viewing choices that you and those in yourhousehold make while using your TiVo DVR, if that information islinked to or associated with your Account Information. Your TiVoDVR stores your viewing information so that it may recommendviewing choices and personalize your viewing experience. We haveworked very hard to design our system to ensure that no PersonallyIdentifiable Viewing Information may be sent to TiVo without yourexpress consent. If you use the TiVo Plus service, you may choose toconsent to TiVo’s collection of Personally Identifiable ViewingInformation by changing your privacy preferences as provided inSection 4.1. NOTE: If your TiVo DVR is receiving the TiVo Basicservice, you may not be able to consent to TiVo’s collection ofPersonally Identifiable Viewing Information from that TiVo DVR.1.3 “Anonymous Viewing Information” means information aboutviewing choices that you and those in your household make whileusing your TiVo DVR, but is not associated with or linked to anyContact Information. Your TiVo DVR sends Anonymous ViewingInformation to TiVo on an ongoing basis. This information allowsTiVo to know that a TiVo service user from a particular ZIP codewatched certain programming but we are unable to associate thoseviewing choices with you. If you use the TiVo Plus service, you mayrequest that TiVo block the collection of Anonymous ViewingInformation from your TiVo DVR as described in Section 4.1.NOTE: If your TiVo DVR is receiving the TiVo Basic service, youmay not opt out of TiVo’s collection of Anonymous ViewingInformation from that TiVo DVR.1.4 “Diagnostic Information” means a log file containing detailedinformation about the operation of your TiVo DVR, such as memoryconsumption, user interface response time, disk space, enclosuretemperature, and enclosure fan speed. Diagnostic Information logscontain your TiVo DVR’s Service Number and are thus associatedwith your Account Information. If you use the TiVo Plus service, youmay request that TiVo block the collection of Diagnostic Informationlogs from your TiVo DVR as described in Section 4.1. NOTE: Ifyour TiVo DVR is receiving the TiVo Basic service, you may not optout of TiVo’s collection of Diagnostic Information from that TiVoDVR.1.5 “Commerce Information” means personally identifiableinformation that enables a commerce partner to fulfill your request toparticipate in a promotion or transaction. From time to time, TiVomay present special offers and/or enable you to purchase goods andservices from TiVo, or third party advertisers or promoters. You
