DEVELOPMENT GUIDANCE SYSTEMSECTION 4ZONING MAP AMENDMENT PROCEDURES4-1 APPLICATION PROCESS Applications for amendments to theZoning Map shall be made only in accordance with this Section.A. INITIATION OF AMENDMENT Applications for amendment tothe Zoning Map shall be filed with the Commission. A request for anamendment may originate from the Commission, the Fiscal Court, theproperty owner or his/her agent. At the time of filing an application fora Zoning Map Amendment, the non-refundable filing fee shall be paid;however, there shall be no filing fee for an amendment requested bythe Fiscal Court, Commission or any other governmental body. If thehearing procedure is initiated by a party other than the owner, theCommission shall promptly notify the owner of the subject property asrequired by KRS Chapter 100. The application shall be made on formsprovided in the commission office.B. EXEMPTIONS Applications for amendment to the Zoning Map, whichare initiated by the Commission or the Fiscal Court, shall be exemptfrom the <strong>Development</strong> Plan and binding elements Section of thisordinance.C. THE PRE-APPLICATION CONFERENCE Prior to submission of anapplication for amendment of the Zoning Map, the applicant or hisagent should meet with the Commission Staff. The purpose ofconference is to discuss, at the earliest stages, the site, the Land UseGroup and the Planning Area in which the site is located, as well as,the goals and objectives of the PLANNING FOR GROWTHCOMPREHENSIVE DEVELOPMENT GUIDE 2008. It is intended thatthis conference will help to alleviate possible conflicts by earlyrecognition of existing conditions, necessary facilities and other issuesrelated to the proposed amendment. The discussion shall include thecharacteristics of the site that would affect the proposed developmentand also what elements may be required on the preliminary<strong>Development</strong> or Site Plan of the proposed project.D. PLAN SUBMISSION All applications for any proposed amendmentto the Zoning Map shall include a <strong>Development</strong> Plan or Site Plan inaccordance with the provisions and requirements of Sections 6 and 7.The <strong>Development</strong> Plan or Site Plan is intended to demonstrate to theCommission the character and objectives of the proposeddevelopment in adequate detail for the Commission to evaluate theeffect the proposed development would have on the community anddetermine what provisions, if any, should be included as part of theplan and be binding on the use and development of the subjectproperty.ZONING MAP AMENDMENT PROCEDURES 59
