DEVELOPMENT GUIDANCE SYSTEM4-4 ZONING MAP AMENDMENT DENIALSMap amendments that have been denied after a public hearing andCommission or Fiscal Court final determination shall not be eligible tosubmit the same project for a second review for a minimum of one yearstarting on the date final action was taken. New proposals which areoutside the four digit Standard Industrial Classification of the rejectedproposal shall be eligible for submission at the applicant's discretion.4-5 ZONING MAP AMENDMENT WITHDRAWALSAny request for a map amendment may be withdrawn upon writtenrequest by the applicant any time prior to the submission of any publichearing notice for advertisement. If the request for withdrawal is madeafter publication of the notice of hearing, such withdrawal shall be onlywith the consent of either the Commission or Fiscal Court, whichever bodyhad advertised the hearing, and no new request concerning any or all ofthe same shall be filed within six months of the date of action, unless therespective body approving withdrawal specifies that the time limitationshall not apply.4-6 ZONING TEXT AMENDMENT PROCESSWhen necessary to further its purposes, this ordinance shall be amendedas per KRS 100.211(2). A proposal to amend the text of the regulationmay originate with either the Commission or Fiscal Court. Textamendments to the Zoning Ordinance shall be made only in accordancewith this Section.A. COMMISSION ACTIONSaid proposals shall be referred to the Commission before adoption.The Commission shall hold at least one (1) public hearing giving noticeby publication of a legal advertisement that shall appear not less thanseven (7) days and no more than twenty-one (21) days prior to thehearing pursuant to KRS Chapter 424.130(b).After voting to recommend that an amendment to the text of thisOrdinance be granted or denied, the Commission shall forward toFiscal Court, a recommendation as to the text of the amendment andwhether the amendment shall be approved or disapproved and shallstate the reasons, in writing, for its recommendation. This action shallbe deemed the Final Action by the Commission on the amendment. Inthe case of a proposed amendment originating with Fiscal Court, theCommission shall make its recommendation within sixty (60) days ofthe date of its receipt of the proposed amendment.ZONING MAP AMENDMENT PROCEDURES 65
