STATE TERM(S) DEFINITION ENUMERATED/ELUCIDATED VIOLATIONS Montana § 45-8-405 New Jersey § 2C:33-29 North Carolina § 14-50.16 Pattern of criminal street gang activity “the commission, solicitation, conspiracy, or attempt, the adjudication as a delinquent youth for the commission, attempt, or solicitation, or the conviction of two or more of the offenses listed in subsection (2) within a three-year period which offenses were committed on separate occasions” Gang criminality “A person is guilty of the crime of gang criminality if, while knowingly involved in criminal street gang activity, he commits, attempts to commit, or conspires to commit, whether as a principal or an accomplice, any crime specified in . . . A crime is committed while involved in a criminal street gang-related activity if the crime was committed for the benefit of, at the direction of, or in association with a criminal street gang” Criminal street gang activity “to commit, to attempt to commit, or to solicit, coerce, or intimidate another person to commit an act or acts, with the specific intent that such act or acts were intended or committed for the purpose, or in furtherance, of the person’s involvement in a criminal street gang or street gang.
