13.3.5 In addition, the following requirements also need to be considered, regardless <strong>of</strong> registration. These include:<br />

n Safe Manning<br />

n Certification <strong>of</strong> Competency and Medical Fitness<br />

n Maritime Security<br />

n Radio Communications<br />

n Safety Management Documentation<br />

n Employment Agreements and Accommodation<br />

n Construction Surveys and Stability<br />

n Civil Liability Certification<br />

13.3.6 For MASS this will require discussion with the Flag State Administration to demonstrate that the proposed<br />

arrangements provide equivalence to the requirements. The requirements outlined in this Code <strong>of</strong> Practice will<br />

support these discussions.<br />

13.3.7 Details <strong>of</strong> Ports <strong>of</strong> Registry and/or Operations should be held with other records.<br />

13.3.8 Subject to provisions <strong>of</strong> UK Laws the UK Ship Registry may grant registration and right to fly its flag to a MASS<br />

bareboat chartered-in by a charterer in the UK for that specific period. The UK Ship Registry shall ensure that a<br />

MASS bareboat chartered in, will be subject to its full jurisdiction and control.<br />

13.4 SURVEY & CERTIFICATION<br />

13.4.1 The different classes <strong>of</strong> MASS, which are outlined in Chapter 1 <strong>of</strong> Part 2 require different certification requirements.<br />

13.4.2 Each and every MASS, whether a new-build or transferring from another Flag, must be surveyed before it can be<br />

registered on the UK Ship Register. These surveys can be undertaken by either MCA or MCA approved Class<br />

surveyors, depending on certain criteria. If the survey is delegated to a Classification Society (or other RO), the<br />

name and contact details <strong>of</strong> the attending surveyor will need to be provided. On receipt, UK Ship Register will<br />

arrange the issue <strong>of</strong> the appropriate Instrument <strong>of</strong> Appointment.<br />

13.4.3 If the survey is carried out by the MCA, the survey application should be made using Form MSF 5100. If, on<br />

completion <strong>of</strong> survey, the surveyor is satisfied that the MASS meets international standards and UK regulations,<br />

where relevant, <strong>of</strong> safety and pollution prevention, short-term certification can be issued immediately. Full<br />

term certification would then follow in due course.<br />

13.4.4 Where mandatory requirements do not apply, the factors in Table 13-2 overleaf should be considered, particularly<br />

when undertaking any risk assessment. This table is not a definitive list: other relevant certification, e.g. safe<br />

manning, ISPS, ISM, base station certification, may also need to be considered.<br />
