TERMS AND CONDITIONS
I/we certify that the information herein is given for the purpose of obtaining credit from SAVORY GOURMET INC., PETROVICH CAVIAR, INC.
and/or its subsidiaries, affiliates or assignees (herein after referred to as the “Companies”). My/our signature(s) authorize(s) the Companies
to check the credit of me/us and my/our business in connection with this application, and I/we further consent to my/our personal credit
report being accessed per my/our signature(s) below. By signing this application I/we am/are agreeing to the terms and conditions set forth
by the Companies. I/we understand that all delinquent account balances will be subject to a late fee charge of 1.5% per month, and all
returned checks are subject to a Twenty Five Dollar ($25.00) service charge per occurence.
Additionally, I/we hereby promise to pay the Companies, any and all collection costs, including reasonable Attorney fees, whether or not any
action for recovery is actually filed, incurred by the Company, in enforcing any provision, covenant or guarantee of this credit application, and
I/we hereby waive to the full extent permitted by law any rights to plead any stature of limitations of laches as a defense to any action
hereunder. The laws of the State of California shall govern all aspects of this credit application and the state courts of California will serve
as the exclusive place of venue and jurisdiction for any dispute arising between the Companies and the Applicant(s).
To induce the Companies to extend credit to the applicant(s), and in consideration thereof, the undersigned(s) hereby personally and unconditionally
guarantee(s) the payment when due of any and all indebtedness which may at any time and from time to time be owing to the
Companies by said applicant(s) or by any successor thereof. All prior notice of default and demand for payment are hereby waived.
This guarantee shall continue in full force and effect until such time as the Companies shall have received from the undersigned written notice
of revocation by registered or certified mail. Such notice of revocation shall be ineffective as to any existing indebtedness or as to any transaction
or commitment previously undertaken by the Companies.
