EL PLAZO DE CADUCIDAD QUE ESTABLECE EL SEGUNDO PÁRRAFO DEL ARTÍCULO 120 DE LA LEY RELATIVA, SE EMPIEZA A COMPUTAR AL DÍA SIGUIENTE DE AQUEL EN QUE VENCE EL PLAZO QUE SE OTORGA A LA AFIANZADORA PARA PRESENTAR AL FIADO, SIN QUE HUBIERA CUMPLIDO. La interpretación sistemática de lo dispuesto en los artículos 120, segundo párrafo y 130 de la Ley Federal de Instituciones de Fianzas, conduce a establecer que tratándose de fianzas penales, el cómputo del plazo de ciento ochenta días naturales que debe transcurrir para la procedencia de la caducidad, inicia en la fecha en que se hace exigible la obligación garantizada a la institución afianzadora, lo cual tiene lugar a partir del día siguiente al del vencimiento del plazo fijado a aquélla para la presentación del fiado, sin que lo hubiera hecho. Ello, porque así se dispone en los preceptos legales invocados y se corrobora con lo establecido en el artículo 95 de la propia ley, que prevé el procedimiento para la efectividad de las fianzas otorgadas a favor de la Federación, del Distrito Federal, de los Estados y de los Municipios, en el que se impone la obligación a la autoridad judicial de comunicar el hecho del incumplimiento de la afianzadora a la autoridad ejecutora correspondiente, acompañándole la documentación relativa a la fianza y a la obligación por ella garantizada, a partir del momento en que aquélla se hace exigible. Además, porque dada la hipótesis descrita y con ello el surgimiento del derecho para exigir el pago a la afianzadora, el plazo de caducidad no puede depender del arbitrio o discrecionalidad del juzgador, o del rezago en sus funciones, pues tal eventualidad, además de resultar contraria a lo establecido en la ley, atentaría contra la seguridad jurídica que requiere certidumbre para el cómputo de los plazos que en cada caso dispongan las leyes.
