EL PREVISTO EN LA LEY FEDERAL DE INSTITUCIONES DE FIANZAS, NO ESTÁ SUJETO A LA SUPLETORIEDAD DEL CÓDIGO DE COMERCIO, NI AL CÓDIGO FEDERAL DE PROCEDIMIENTOS CIVILES. De la interpretación gramatical que se hace del artículo 94, fracción IV, de la Ley Federal de Instituciones de Fianzas, se aprecia la procedencia del recurso de apelación, en la totalidad de los casos en que se trate de sentencias dictadas en juicios seguidos contra instituciones de fianzas, por lo que de considerar lo contrario se estaría haciendo distingo donde la ley no lo permite, de ahí que no se deba sujetar dicha procedencia a lo que disponga la ley supletoria, dado que en el caso, la legislación especial prevé dicho medio de defensa, sin excepción alguna y en tal circunstancia, no puede haber supletoriedad, ni del Código de Comercio, ni del Código Federal de Procedimientos Civiles, pues en general, para que se considere aquélla deben satisfacerse determinados requisitos como: a) Que el ordenamiento a suplir, la admita expresamente y señale el estatuto supletorio; b) Que el ordenamiento, sujeto de la supletoriedad, prevenga la institución; c) Que previendo la misma, las normas existentes en el cuerpo a suplir, sean insuficientes para su aplicación a la situación concreta, por carencia total o parcial de la reglamentación necesaria; y d) Que las disposiciones o principios con los que se vaya a llenar la deficiencia, no contraríen las bases esenciales del sistema legal de sustentación. Al respecto, si bien es cierto que en la especie se cumplen algunos requisitos de los enunciados como la existencia del ordenamiento legal a suplir, la Ley Federal de Instituciones de Fianzas, que admite la supletoriedad de manera expresa del Código de Comercio y del Código Federal de Procedimientos Civiles y la misma ley especial como objeto de la supletoriedad, en cuanto a que contempla el recurso de apelación, también es verdad que, no se dan otras condiciones, pues la norma a suplir no es insuficiente para su aplicación a la situación concreta, porque no hay carencia total, ni parcial de la reglamentación a estudio, porque la procedencia del recurso es una cuestión que no está deficientemente regulada sino expresamente prevista en la Ley Federal de Instituciones de Fianzas, y no hay laguna que suplir. Por otro lado el artículo 1340 del Código de Comercio que admite la procedencia del recurso de apelación, sólo en los casos en que se alcance determinada cuantía, desde luego que contradice lo establecido en el artículo 94, fracción IV, de la ley especial referida, dado que este precepto no señala casos de excepción. En este sentido, la aplicación de las leyes supletorias, sólo tiene lugar en aquellas normas que se encuentren carentes o deficientemente reglamentadas; esto es, la supletoriedad de una norma opera ante la insuficiencia reguladora de otra, siempre condicionada a que la figura respectiva se halle contemplada en el ordenamiento a suplir, y que no contraríe los principios que sustente la ley suplida. Luego, la circunstancia de que en la Ley Federal de Instituciones de Fianzas, no exista excepción respecto a la procedencia del recurso de apelación, promovido contra sentencias dictadas en los juicios seguidos contra instituciones de fianzas es suficiente para considerar que las condiciones expuestas en el artículo 1340 del Código de Comercio, no operen, en la especie.
