J/16 Página: 361 FIANZAS OTORGADAS EN FAVOR DE LA FEDERACIÓN PARA GARANTIZAR OBLIGACIONES FISCALES A CARGO DE TERCEROS, SON INAPLICABLES LOS ARTÍCULOS 67 Y 146 DEL CÓDIGO FISCAL DE LA FEDERACIÓN, EN CUANTO A LAS FIGURAS JURÍDICAS DE CADUCIDAD Y PRESCRIPCIÓN. Tratándose del procedimiento para hacer efectivas las fianzas otorgadas en favor de la Federación para garantizar obligaciones fiscales a cargo de terceros, el artículo 95 de la ley que rige la materia, remite al Código Fiscal de la Federación. La Segunda Sala de la Suprema Corte de Justicia de la Nación determinó, que por lo que se refiere a ese tipo de garantías, la figura de la caducidad a que alude el dispositivo 120 de la Ley Federal de Instituciones de Fianzas no es aplicable, porque el beneficiario es la Federación. En igual forma, determinó que las figuras jurídicas de la caducidad y de la prescripción, que prevén los artículos 67, fracción II, y 146 del Código Fiscal de la Federación, tampoco son aplicables, porque la primera sólo hace referencia a la extinción de las facultades de las autoridades fiscales para determinar contribuciones omitidas y sus accesorios, así como para imponer sanciones por omisiones a las disposiciones relativas; y la segunda, por su particular regulación. Por tanto, no es jurídicamente aceptable que se estime que opera la caducidad de esta facultad en el plazo de cinco años, conforme al artículo 67, fracción II, del Código Fiscal de la Federación, pues dicha disposición legal no es exactamente aplicable al caso, dado que no se configura la hipótesis jurídica que contempla, como se estableció al resolver la contradicción de tesis número 86/95 sustentada por la Segunda Sala de la Suprema Corte de Justicia de la Nación, publicada en la página 203, Tomo IV, agosto de 1996, Novena Época, del Semanario Judicial de la Federación de rubro: "FIANZAS OTORGADAS EN FAVOR DE LA FEDERACIÓN PARA GARANTIZAR OBLIGACIONES FISCALES A CARGO DE TERCEROS, ES INAPLICABLE EL ARTÍCULO 120 DE LA LEY FEDERAL DE INSTITUCIONES DE FIANZAS, EN CUANTO PREVÉ LA CADUCIDAD EN FAVOR DE LAS INSTITUCIONES GARANTES.".
