his remarks, Murray turned the briefing over to Davis, st<strong>at</strong>ing, "I'll turn the meeting over to<br />

Mr. Al Davis, the District Manager <strong>of</strong> the Federal <strong>Mine</strong> Safety and Health Administr<strong>at</strong>ion for<br />

anything he would like to say and then I'll be pleased to answer any questions th<strong>at</strong> you have. .<br />

. . " Davis commented, in brief, on the removal <strong>of</strong> debris from the entries, transport<strong>at</strong>ion <strong>of</strong><br />

machinery to the mine, performance limit<strong>at</strong>ions <strong>of</strong> the seismic equipment, and the intended<br />

functions <strong>of</strong> the boreholes. Thereafter, Murray asked the assembled reporters if they had any<br />

questions. A number <strong>of</strong> questions were asked by the reporters and Murray undertook<br />

responsibility for responding to the overwhelming majority <strong>of</strong> those questions.<br />

On the morning <strong>of</strong> Tuesday, August 7 th , <strong>at</strong> approxim<strong>at</strong>ely 9:15 a.m. MDT, another press<br />

conference was conducted. For many reasons, this briefing was particularly illustr<strong>at</strong>ive <strong>of</strong> the<br />

subordin<strong>at</strong>e role to which <strong>MSHA's</strong> primary communic<strong>at</strong>ors had <strong>at</strong> the press briefings. During<br />

this briefing, Murray again assumed the role <strong>of</strong> chief spokesperson and primary<br />

communic<strong>at</strong>or, st<strong>at</strong>ing th<strong>at</strong> the press would "hear from Mr. Davis l<strong>at</strong>er." As with the press<br />

briefing discussed above, Murray provided comments <strong>at</strong> length, many <strong>of</strong> which were<br />

unsubstanti<strong>at</strong>ed and/or unrel<strong>at</strong>ed to the ongoing rescue effort. During this press briefing,<br />

Murray:<br />

• insisted th<strong>at</strong> the ground failure was the result <strong>of</strong> an earthquake;<br />

• st<strong>at</strong>ed th<strong>at</strong> he and MSHA knew exactly where the missing miners were loc<strong>at</strong>ed;<br />

• discussed his personal opinions <strong>of</strong> global warming legisl<strong>at</strong>ion and n<strong>at</strong>ional energy<br />

policy, st<strong>at</strong>ing th<strong>at</strong> "every one <strong>of</strong> these global warming bills th<strong>at</strong> has been introduced in<br />

Congress to d<strong>at</strong>e elimin<strong>at</strong>es the coal industry and will increase your electric r<strong>at</strong>e four- to<br />

five-fold" and th<strong>at</strong> "people on fixed incomes will not be able to pay their electric bills";<br />

• provided his opinion th<strong>at</strong> the coal industry is essential to the U.S. standard <strong>of</strong> living and<br />

the ability <strong>of</strong> products manufactured in the U.S. to compete in the global marketplace;<br />

• implored the press to "please accept my <strong>of</strong>fer" to go to one <strong>of</strong> his underground Utah<br />

coal mines once the rescue oper<strong>at</strong>ion had concluded;<br />

• discussed the origin and corpor<strong>at</strong>e rel<strong>at</strong>ionships <strong>of</strong> Murray Energy;<br />

• discussed his personal mining experiences;<br />

• st<strong>at</strong>ed his belief th<strong>at</strong> the Lord had already determined the missing miners' f<strong>at</strong>e;<br />

• st<strong>at</strong>ed th<strong>at</strong> there was no "retre<strong>at</strong> mining" occurring in the immedi<strong>at</strong>e vicinity <strong>of</strong> the<br />

miners. Further, Murray insisted th<strong>at</strong> the press should:<br />

take the word retre<strong>at</strong> mining out <strong>of</strong> [their] vocabulary<br />

[because] those were words invented by . . . [people] . . .<br />

who are lackeys for the United <strong>Mine</strong> Workers, and<br />

<strong>of</strong>ficials <strong>at</strong> the United <strong>Mine</strong> Workers th<strong>at</strong> would like to<br />

organize this coal mine. You people don't understand<br />

th<strong>at</strong>. I'm telling you th<strong>at</strong>. Th<strong>at</strong>'s a fact! Retre<strong>at</strong> mining<br />

had absolutely nothing to do with the disaster th<strong>at</strong><br />

happened here, nor was there any retre<strong>at</strong> mining<br />
