three days before the beginning <strong>of</strong> a calendar quarter, Farmer st<strong>at</strong>ed th<strong>at</strong> a call was received<br />

indic<strong>at</strong>ing th<strong>at</strong> the conveyor belts and other machinery and equipment <strong>at</strong> the <strong>Crandall</strong> <strong>Canyon</strong><br />

<strong>Mine</strong> needed to be “looked <strong>at</strong>.” While they immedi<strong>at</strong>ely investig<strong>at</strong>ed the alleg<strong>at</strong>ions, no<br />

record <strong>of</strong> this investig<strong>at</strong>ion was made in the complaint d<strong>at</strong>abase.<br />

Conclusion: The Price Field Office was not investig<strong>at</strong>ing all complaints as required.<br />

Complaints given to Field Office personnel verbally in public places were not responded to in<br />

accordance with MSHA’s policies and procedures.<br />

All complaints were not entered into the Hazardous Conditions Complaint d<strong>at</strong>abase.<br />

Recommend<strong>at</strong>ion: The District 9 Manager should ensure th<strong>at</strong> the Price Field Office complies<br />

with the Hazards Complaint Procedures Handbook.<br />

The District 9 Manager should ensure th<strong>at</strong> all appropri<strong>at</strong>e hazard complaints are entered into<br />

the Hazardous Condition Complaint d<strong>at</strong>abase.<br />

Erroneous D<strong>at</strong>es on E01 Event # 4474428 Documents<br />

The report for E01 Event # 4474428, conducted from May 30 th through July 10, 2007, contained<br />

notes and documents with d<strong>at</strong>es <strong>of</strong> January and February, 2007. The misd<strong>at</strong>ed notes and<br />

documents are:<br />

• The notes included after June 26 th have a d<strong>at</strong>e <strong>of</strong> “27 Jan 07” on pages 1 and 2 (but “27<br />

June 07” on page 3);<br />

• The notes included after June 30 th have a d<strong>at</strong>e <strong>of</strong> “02 Feb 07” on the Daily Cover Sheet;<br />

• The General Inform<strong>at</strong>ion Cover Sheet shows a Post-Inspection Conference D<strong>at</strong>e <strong>of</strong> ”02<br />

Feb 07”; and<br />

• The Plan <strong>Review</strong> form, MSHA Form 2000-204, is d<strong>at</strong>ed “02 Feb 07.”<br />

The review <strong>of</strong> inspection time charged to this event revealed th<strong>at</strong> the inspector was <strong>at</strong> the mine<br />

on June 27 th and July 2, 2007. These d<strong>at</strong>es coincide with the “27 Jan” and “02 Feb” d<strong>at</strong>es. The<br />

inspection time review also showed th<strong>at</strong> the last d<strong>at</strong>e the inspector was <strong>at</strong> the mine was July<br />

2 nd . The notes d<strong>at</strong>ed “02 Feb 07” document th<strong>at</strong> the E01 inspection was concluded on th<strong>at</strong><br />

d<strong>at</strong>e.<br />

The report also contains an ATF E-Form 5030.5 th<strong>at</strong> is d<strong>at</strong>ed “02 July 07.” The inspector st<strong>at</strong>ed<br />

th<strong>at</strong> this form is completed after the post-inspection conference <strong>at</strong> the end <strong>of</strong> the inspection,<br />

along with the plan review form. The inspector st<strong>at</strong>ed th<strong>at</strong> he started to write “02 Feb 07” on<br />

the ATF form, but realized the error and wrote “02 July 07” on it instead. This correction is<br />

visible on the form.<br />
