subpoenaed, such committee may file a complaint before any circuit court <strong>of</strong> the<br />

state setting up such failure on the part <strong>of</strong> the witness. On the filing <strong>of</strong> such<br />

complaint, the court shall take jurisdiction <strong>of</strong> the witness and the subject matter<br />

<strong>of</strong> the complaint and shall direct the witness to respond to all lawful questions<br />

and to produce all documentary evidence in the possession <strong>of</strong> the witness which<br />

is lawfully demanded. The failure <strong>of</strong> a witness to comply with such order <strong>of</strong> the<br />

court constitutes a direct and criminal contempt <strong>of</strong> court, and the court shall<br />

punish the witness accordingly.<br />

(5) All witnesses summoned before any such committee shall receive<br />

reimbursement for travel expenses and per diem at the rates provided in s.<br />

112.061. However, the fact that such reimbursement is not tendered at the time<br />

the subpoena is served does not excuse the witness from appearing as directed<br />

therein.<br />

11.25 Salaries and expenditures not subject to control <strong>of</strong> executive<br />

agencies.—<br />

(1) The Legislature hereby declares and determines that the employees<br />

<strong>of</strong> the several <strong>of</strong>fices, committees, and other divisions <strong>of</strong> the Legislature are and<br />

shall continue to be groups <strong>of</strong> employees employed by the Legislature to<br />

perform such services as may be provided by law, by rule <strong>of</strong> the respective<br />

house, or directed by the joint committee, whichever is applicable. Such <strong>of</strong>fices,<br />

committees and divisions are not agencies <strong>of</strong> government within the intent <strong>of</strong> the<br />

Legislature as expressed in chapters 216 and 287.<br />

(2) Agencies <strong>of</strong> the executive branch shall have no power to determine<br />

the number or fix the compensation <strong>of</strong> legislative employees or exercise any<br />

manner <strong>of</strong> control over them. The selection <strong>of</strong> such employees, the<br />

determination <strong>of</strong> their qualifications and compensation, and the establishment <strong>of</strong><br />

policies relating to their work, including hours <strong>of</strong> work, leave, and other matters,<br />

shall be the sole prerogative <strong>of</strong> the Legislature.<br />

11.26 Legislative employees; employment restrictions.—No employee <strong>of</strong> the<br />

Legislature shall:<br />

(1) Subject to the provisions <strong>of</strong> s. 11.0431, reveal to any person outside<br />

the area <strong>of</strong> the employee's direct responsibility the contents or nature <strong>of</strong> any<br />

request for services made by any member <strong>of</strong> the Legislature, except with the<br />

consent <strong>of</strong> the member making such request.<br />

(2) Give legal advice on any subject to any person, firm, or<br />

corporation, except members or staff <strong>of</strong> the Legislature.<br />

(3) No full-time legislative employee shall be otherwise employed,<br />

except with the written permission <strong>of</strong> the presiding <strong>of</strong>ficer <strong>of</strong> the house by which<br />

he or she is employed. Employees <strong>of</strong> joint committees must have the permission<br />

<strong>of</strong> the presiding <strong>of</strong>ficers <strong>of</strong> both houses.<br />

11.40 Legislative Auditing Committee.—<br />

(1) The Legislative Auditing Committee may take under investigation<br />

any matter within the scope <strong>of</strong> an audit, review, or examination either completed<br />
