(1) A general proposition amending a specific proposition.<br />
(2) An amendment amending a statute or session law when the purpose<br />
<strong>of</strong> the bill is limited to repealing such law, or an amendment repealing a statute<br />
or session law when the purpose <strong>of</strong> the bill is limited to amending such law.<br />
(3) An amendment that substantially expands the scope <strong>of</strong> the bill.<br />
(4) An amendment to a bill when legislative action on that bill is by<br />
law or these rules limited to passage, concurrence, or nonconcurrence as<br />
introduced.<br />
(c) AMENDMENTS THAT ARE GERMANE. Amendments that are<br />
germane include:<br />
(1) A specific provision amending a general provision.<br />
(2) An amendment that accomplishes the same purpose in a different<br />
manner.<br />
(3) An amendment limiting the scope <strong>of</strong> the proposal.<br />
(4) An amendment providing appropriations necessary to fulfill the<br />
original intent <strong>of</strong> a proposal.<br />
(5) An amendment that changes the effective date <strong>of</strong> a repeal, reduces<br />
the scope <strong>of</strong> a repeal, or adds a short-term nonstatutory transitional provision to<br />
facilitate repeal.<br />
(d) WAIVER OF RULE. Waiver <strong>of</strong> this rule shall require unanimous<br />
consent <strong>of</strong> the <strong>House</strong>.<br />
12.9—Floor Amendments Out <strong>of</strong> Order<br />
A floor amendment is out <strong>of</strong> order if it is the principal substance <strong>of</strong> a bill that<br />
has:<br />
(a) Received an unfavorable committee or subcommittee report,<br />
(b) Been withdrawn from further consideration, or<br />
(c) Not been reported favorably by at least one committee or<br />
subcommittee <strong>of</strong> reference,<br />
and may not be <strong>of</strong>fered to a bill on second or third reading. Any amendment<br />
that is substantially the same, and identical as to specific intent and purpose, as<br />
the measure residing in a committee or subcommittee <strong>of</strong> reference is covered by<br />
this rule.<br />
12.10—Printing <strong>of</strong> Amendments in Journal<br />
All amendments taken up, unless withdrawn, shall be printed in the Journal,<br />
except that an amendment to an appropriations bill constituting an entirely new<br />
bill shall not be printed except upon consideration <strong>of</strong> the conference committee<br />
report.<br />
