shall develop its own recommendation. If the complaint is against the Chair <strong>of</strong><br />

the Rules & Calendar Committee, the chair is excused and the vice chair shall<br />

conduct the deliberation. If the Rules & Calendar Committee votes to dismiss<br />

the complaint, the Chair <strong>of</strong> the Rules & Calendar Committee or vice chair shall<br />

dismiss the complaint. Otherwise, the special master's or select committee's<br />

report and recommendation and the recommendation <strong>of</strong> the Rules & Calendar<br />

Committee shall be presented to the Speaker.<br />

(e) The Speaker shall present the committee's recommendation, along<br />

with the special master's report and recommendation, to the <strong>House</strong> for <strong>final</strong><br />

action.<br />

(f) Nothing in this rule prohibits the Chair <strong>of</strong> the Rules & Calendar<br />

Committee from correcting or preventing the alleged violation by informal<br />

means if the chair determines that a violation is inadvertent, technical, or<br />

otherwise de minimis.<br />

(g) Nothing in this rule prohibits the respondent and the Chair <strong>of</strong> the<br />

Rules & Calendar Committee, the special master, or a select committee from<br />

agreeing to a consent decree, which shall state findings <strong>of</strong> fact, and such penalty<br />

as may be appropriate. If the <strong>House</strong> accepts the consent decree, the complaint<br />

pursuant to these rules shall be resolved.<br />

(h) The <strong>House</strong> may move forward with disciplinary proceedings<br />

without waiting for the outcome <strong>of</strong> a criminal case.<br />

18.3—Confidentiality<br />

Any material provided to the <strong>House</strong> in response to a complaint filed under Rule<br />

18 that is confidential under applicable law shall remain confidential and shall<br />

not be disclosed except as authorized by applicable law. Execpt as otherwise<br />

provided in this rule, a complaint and the records relating to a complaint shall<br />

be available for public inspection upon the dismissal <strong>of</strong> a complaint, a<br />

determination as to probable cause, informal resolution <strong>of</strong> a complaint, or the<br />

receipt by the Speaker <strong>of</strong> a request in writing from the respondent that the<br />

complaint and other records relating to the complaint be made public records.<br />

18.4—Conflict<br />

If a complaint is filed against the Chair <strong>of</strong> the Rules & Calendar Committee, the<br />

initial review <strong>of</strong> the complaint shall be managed by the Speaker or, if<br />

designated by the Speaker, the Speaker pro tempore. If a complaint is filed<br />

against the Speaker, the duties <strong>of</strong> the Speaker pursuant to Rule 18 shall be<br />

transferred to the Speaker pro tempore.<br />

18.5—Time Limitations<br />

(a) A complaint must be filed with the Speaker within 2 years after the<br />

alleged violation.<br />
