university and its articulation with free public<br />

schools and community colleges, ensuring the<br />

well-planned coordination and operation <strong>of</strong> the<br />

system, and avoiding wasteful duplication <strong>of</strong><br />

facilities or programs. The board’s management<br />

shall be subject to the powers <strong>of</strong> the legislature to<br />

appropriate for the expenditure <strong>of</strong> funds, and the<br />

board shall account for such expenditures as<br />

provided by law. The governor shall appoint to<br />

the board fourteen citizens dedicated to the<br />

purposes <strong>of</strong> the state university system. The<br />

appointed members shall be confirmed by the<br />

senate and serve staggered terms <strong>of</strong> seven<br />

years as provided by law. The commissioner <strong>of</strong><br />

education, the chair <strong>of</strong> the advisory council <strong>of</strong><br />

faculty senates, or the equivalent, and the<br />

president <strong>of</strong> the <strong>Florida</strong> student association, or<br />

the equivalent, shall also be members <strong>of</strong> the<br />

board.<br />

Sec.<br />

27. Comprehensive Statewide Tobacco Education<br />

And Prevention Program.<br />

SECTION 1. Amendments to United<br />

States Constitution.—The legislature shall not<br />

take action on any proposed amendment to the<br />

constitution <strong>of</strong> the United States unless a majority<br />

<strong>of</strong> the members there<strong>of</strong> have been elected<br />

after the proposed amendment has been submitted<br />

for ratification.<br />

SECTION 2. Militia.—<br />

(a) The militia shall be composed <strong>of</strong> all<br />

ablebodied inhabitants <strong>of</strong> the state who are or<br />

have declared their intention to become citizens<br />

<strong>of</strong> the United States; and no person because <strong>of</strong><br />

religious creed or opinion shall be exempted<br />

from military duty except upon conditions provided<br />

by law.<br />

(b) The organizing, equipping, housing,<br />

maintaining, and disciplining <strong>of</strong> the militia, and<br />

the safekeeping <strong>of</strong> public arms may be provided<br />

for by law.<br />

(c) The governor shall appoint all commissioned<br />

<strong>of</strong>ficers <strong>of</strong> the militia, including an adjutant<br />

general who shall be chief <strong>of</strong> staff. The appointment<br />

<strong>of</strong> all general <strong>of</strong>ficers shall be subject to<br />

confirmation by the senate.<br />

(d) The qualifications <strong>of</strong> personnel and <strong>of</strong>ficers<br />

<strong>of</strong> the federally recognized national guard,<br />

including the adjutant general, and the grounds<br />

and proceedings for their discipline and removal<br />

shall conform to the appropriate United States<br />

army or air force regulations and usages.<br />

SECTION 3. Vacancy in <strong>of</strong>fice.—Vacancy<br />

in <strong>of</strong>fice shall occur upon the creation <strong>of</strong> an <strong>of</strong>fice,<br />

upon the death, removal from <strong>of</strong>fice, or resignation<br />

<strong>of</strong> the incumbent or the incumbent’s succession<br />

to another <strong>of</strong>fice, unexplained absence for<br />

sixty consecutive days, or failure to maintain the<br />

residence required when elected or appointed,<br />

and upon failure <strong>of</strong> one elected or appointed to<br />

<strong>of</strong>fice to qualify within thirty days from the<br />

commencement <strong>of</strong> the term.<br />

SECTION 4. Homestead; exemptions.—<br />

(a) There shall be exempt from forced sale<br />

under process <strong>of</strong> any court, and no judgment,<br />

decree or execution shall be a lien thereon,<br />

except for the payment <strong>of</strong> taxes and assessments<br />

thereon, obligations contracted for the<br />

purchase, improvement or repair there<strong>of</strong>, or<br />

obligations contracted for house, field or other
