(4) Request the Senate to recede and, if the Senate refuses to recede, to<br />

appoint a conference committee to meet with a like committee appointed by the<br />

Speaker.<br />

(b) If the Senate refuses to concur in a <strong>House</strong> amendment to a Senate<br />

bill, the following motions shall be in order and shall be privileged in the order<br />

named:<br />

(1) That the <strong>House</strong> recede.<br />

(2) That the <strong>House</strong> insist and ask for a conference committee.<br />

(3) That the <strong>House</strong> insist.<br />

(c) The Speaker may, upon determining that a Senate amendment<br />

substantially changes the bill as passed by the <strong>House</strong>, refer the Senate message,<br />

with the bill and Senate amendment or amendments, to the appropriate <strong>House</strong><br />

committee or subcommittee for review and report to the <strong>House</strong>. The Speaker,<br />

upon such reference, shall announce the date and time for the committee or<br />

subcommittee to meet. The committee or subcommittee shall report to the<br />

<strong>House</strong> the recommendation for disposition <strong>of</strong> the Senate amendment or<br />

amendments under one <strong>of</strong> the four options presented in subsection (a). The<br />

report shall be furnished to the Clerk and to the <strong>House</strong>, in writing, by the chair<br />

<strong>of</strong> the reporting committee or subcommittee.<br />

12.7—Motion to Amend by Removing Enacting or Resolving Clause<br />

An amendment to remove the enacting clause <strong>of</strong> a bill or the resolving clause <strong>of</strong><br />

a resolution or memorial shall, if carried, be considered equivalent to rejection<br />

<strong>of</strong> the bill, resolution, or memorial by the <strong>House</strong>.<br />

12.8—Germanity <strong>of</strong> <strong>House</strong> Amendments<br />

(a) GERMANITY.<br />

(1) Neither the <strong>House</strong> nor any committee or subcommittee shall<br />

consider an amendment that relates to a different subject or is intended to<br />

accomplish a different purpose than that <strong>of</strong> the pending question or that, if<br />

adopted, would require a title amendment for the bill that is substantially<br />

different from the bill's original title or that would unreasonably alter the nature<br />

<strong>of</strong> the bill.<br />

(2) The Speaker, or the chair in the case <strong>of</strong> an amendment <strong>of</strong>fered in<br />

committee or subcommittee, shall determine the germanity <strong>of</strong> any amendment<br />

when the question is timely raised.<br />

(3) An amendment <strong>of</strong> the second degree or a substitute amendment<br />

must be germane to both the main amendment and the measure to which it<br />

adheres.<br />

(b) AMENDMENTS THAT ARE NOT GERMANE. <strong>House</strong><br />

amendments that are not germane include:<br />
