SECTION W: DISCIPLINARY<br />

Appeals Old Rule<br />

W.59. A Club (or club) or person aggrieved by: R.55<br />

W.59.1. the decision of the Board to impose a fixed penalty; or<br />

W.59.2. the decision of a Commission before which such Club or person appeared<br />

as Respondent; or<br />

W.59.3. the amount of compensation (if any) which a Commission has, pursuant to<br />

Rule W.52.5, ordered either that it shall pay or that shall be paid in its favour;<br />

may appeal in accordance with the provisions of these Rules against the decision,<br />

the penalty or the amount of compensation (as appropriate).<br />

W.60. An appeal shall lie to an Appeal Board which shall be appointed by the Board and,<br />

subject to Rule W.61, shall comprise 3 members of the Panel of whom one, who<br />

shall have held judicial office, shall sit as chairman of the Appeal Board, and the<br />

other two of whom shall be members of the Council of the Football Association<br />

who are not Officials.<br />

W.61. No member of the Panel shall be appointed to an Appeal Board to hear an appeal<br />

against the decision of a Commission of which he was a member.<br />

W.62. The parties to an appeal shall be:<br />

W.62.1. a Respondent to a charge; and/or<br />

W.62.2. a Person, Club or club pursuant to Rule W.59.3; and/or<br />

W.62.3. the Board.<br />

W.63. An appeal against the decision of the Board to impose a fixed penalty shall be<br />

in Form 37.<br />

W.64. An appeal against the decision of a Commission shall be in Form 38. R.60<br />

W.65. An appeal shall be commenced by the appellant sending or delivering to the<br />

Secretary Form 37 or Form 38, as the case may be, so that he receives the same<br />

together with a deposit of £1,000 within 14 days of the date of the decision<br />

appealed against (time of the essence).<br />

W.66. The Appeal Board may give directions as it thinks fit for the future conduct of the<br />

appeal, addressed in writing to the parties, or require the parties to attend a<br />

directions hearing.<br />

W.67. Any party to an appeal may apply for permission to adduce fresh evidence. Such<br />

permission shall only be granted if it can be shown that the evidence was not<br />

available to the party and could not have been obtained by such party with<br />

reasonable diligence, at the time at which the Commission heard the complaint.<br />

W.68. Notice of the date, time and place of the appeal hearing shall be given in writing<br />

to the parties by the chairman of the Appeal Board.<br />

W.69. If a party fails, refuses or is unable to attend the hearing the Appeal Board may<br />

either adjourn it or proceed in the party’s absence.<br />
