are above written, doe ingage that if wee & the aforesaid Samuel cannot aggree<br />

about the price <strong>of</strong> any <strong>of</strong> the aforementioned pay, then wee will st<strong>and</strong> to w'<br />

Captayne Pynchon, & Lieutenante Holyoke shall appoynt.<br />

Ciittonus figured occasionally iu the records. He was fined in 1660<br />

for not keeping up his " water fence." He owned l<strong>and</strong>s og the west<br />

side <strong>of</strong> the " Greate Ryver," <strong>and</strong> had previously sold some planting-<br />

grounds to Ensign Cooper, who, the year following the above mort-<br />

gage, secured a record <strong>of</strong> this transaction. Cooper had himself ob-<br />

tained Indian l<strong>and</strong>s <strong>by</strong> the foreclosure process. He had taken from<br />

a Woronoco Indian, named Amoacusseu, a mortgage in 1660, <strong>and</strong> in<br />

1664 he received an absolute deed upon tlie Indian's failure to pay.<br />

John Pynchon also foreclosed, in 1666, upon a large tract <strong>of</strong> l<strong>and</strong> in<br />

Woronoco, mortgaged <strong>by</strong> an Indian <strong>and</strong> his squaw. Mr. Cooper was<br />

before the General Court in reference to the Amoacussen transaction.<br />

It was claimed b}' Allignot, Neemp, <strong>and</strong> Wallump, sachems <strong>of</strong><br />

" Pochosick near Westfield," that Amoacussen was not the sole<br />

owner <strong>of</strong> the l<strong>and</strong>s deeded to Cooper. These Indians appealed, as<br />

they had a right to do, to Boston, <strong>and</strong> the General Court referred the<br />

case to the Hampshire County Court, which compelled Cooper to<br />

give the sachems due satisfaction. It cost Cooper one hundred <strong>and</strong><br />

ten fathom <strong>of</strong> wampum to get out <strong>of</strong> this scrape ; but he doubtless<br />

made money even at that.<br />

We transcribe the following deed <strong>of</strong> Westfield l<strong>and</strong> :<br />

ate & Sell unto Daniell Clark & Samuel Marshall <strong>of</strong> Windsor their heirs & as-<br />

signes one pcell <strong>of</strong> meddow L<strong>and</strong> lying at Woronoco on y*^^ South Side <strong>of</strong> y^<br />

l?iver part where<strong>of</strong> hath been already planted w^^'' pcell <strong>of</strong> Meddow is in quantity<br />

fforty acres, such pcell <strong>of</strong> meddow L<strong>and</strong>, it shall be Lawfnll for the Said Daniell<br />

& Samuel their heirs & assigns to enjoy & possess & inheritt forever. And for<br />
