suitability tests and analysis, a phasing plan, if applicable, a construction<br />

mitigation plan and a landscape maintenance plan.<br />

7.1.4.4 Filing the Application: The applicant shall submit the application for Site Plan<br />

Approval to the <strong>Town</strong> Clerk and a date and time-stamped copy there<strong>of</strong> to the Planning<br />

Board or its designee. The date <strong>of</strong> filing shall be the date after which the application was<br />

received by the Clerk and the Planning Board or its designee.<br />

7.1.4.5 Pre-Application Meeting, Notice and Hearing: The Planning Board strongly<br />

encourages the applicant to present and discuss the general development concept for the<br />

proposed project at one <strong>of</strong> its posted meetings prior to filing an application. The<br />

applicant may present as many or as few <strong>of</strong> the details listed in Section 7.1.4.3 as desired.<br />

7.1.4.6 Site Plan Review and Approval Procedures:<br />

a. Within seven (7) business days after the filing <strong>of</strong> an application for Site Plan<br />

Approval, the Planning Board may submit one (1) copy <strong>of</strong> the site plan each to the<br />

Board <strong>of</strong> Selectmen, the Board <strong>of</strong> Health, the Conservation Commission, the<br />

Inspector <strong>of</strong> Buildings, the Superintendent <strong>of</strong> Highways, and the Sewer Commission<br />

and ask for their comments.<br />

b. Within sixty-five (65) days <strong>of</strong> the filing <strong>of</strong> an application for Site Plan Approval, the<br />

Planning Board shall provide notice and hold a public hearing noticed in accordance<br />

with the requirements set forth in GL 40A §§11 and 15. A majority vote <strong>of</strong> the<br />

Planning Board is required for approval <strong>of</strong> a Site Plan.<br />

c. Within ninety (90) days after the initial date <strong>of</strong> the public hearing, the Planning Board<br />

shall take its final action on the application (render its decision, file its decision with<br />

the <strong>Town</strong> Clerk and notify the Applicant <strong>of</strong> its decision).<br />

d. At the applicant's written request, the Planning Board may extend the time period in<br />

7.1.4.6(b) and (c) unless extended pursuant to 7.1.4.6(d) shall constitute approval <strong>of</strong><br />

the Site Plan as provided in GL 40A Section 11.<br />

e. Failure <strong>of</strong> the Planning Board to act within any <strong>of</strong> the time periods listed above in<br />

7.1.4.6(b) and (c) unless extended pursuant to 7.1.4.6(d) shall constitute approval to<br />

the Site Plan as provided in GL 40A Section 11.<br />

7.1.4.7 Review and Approval Criteria<br />

a. The Planning Board shall approve a Site Plan for projects with “P” uses if the<br />

applicant demonstrates to the Planning Board that the project is properly designed in<br />

the following site design categories:<br />
