5.8.3 Lighting<br />

Exterior illumination shall be only as necessary for safety and lighting <strong>of</strong> buildings, walks and<br />

roads. All lighting shall be arranged and shielded so as to prevent glare from the light source<br />

onto any public way or any other property. No light standard shall be taller than twenty-five (25)<br />

feet. All light standards shall be in a style approved by the Planning Board.<br />

5.8.4 Utility Areas<br />

The Planning Board may require exposed storage areas, dumpsters, machinery, service areas,<br />

utility buildings and/or other unsightly use to be screened from view from neighboring properties<br />

and streets through the use <strong>of</strong> berms, fences or landscaping.<br />

5.8.5 Utility Services<br />

All on-site utilities shall be placed underground, unless permission is otherwise granted by the<br />

Planning Board.<br />

5.8.6 Procedures<br />

If new lots are created that require the approval <strong>of</strong> the Planning Board under the Subdivision<br />

Control Law, the applicant shall submit a definitive plan and seek approval <strong>of</strong> a subdivision.<br />

Development on individual lots, or development <strong>of</strong> an <strong>of</strong>fice or industrial park on a single lot, or<br />

on multiple lots, requires approval <strong>of</strong> a site plan under Section 7.1.4 <strong>of</strong> this Zoning Bylaw. The<br />

applicant may submit the materials required for both applications simultaneously in order to<br />

expedite the review process.<br />

5.9 Special Permits for Adult Uses<br />

5.9.1 Purpose and Intent:<br />

It has been documented in numerous other towns and cities throughout the Commonwealth <strong>of</strong><br />

Massachusetts and elsewhere in the United States that Adult Entertainment uses are<br />

distinguishable from other business uses and that the location <strong>of</strong> Adult Entertainment uses<br />

degrade the quality <strong>of</strong> life in the areas <strong>of</strong> a community where they are located, with impacts<br />

including increased levels <strong>of</strong> crime, blight, and late hours <strong>of</strong> operation resulting in noise and<br />

traffic late into the night. Therefore, this bylaw is enacted pursuant to MGL, Chapter 40A,<br />

Section 9 and Section 9A to serve the compelling <strong>Town</strong> interests by regulating and limiting the<br />

location <strong>of</strong> adult entertainment enterprises as defined herein. This regulation will promote the<br />

<strong>Town</strong> <strong>of</strong> <strong>Charlton</strong>'s great interest in protecting and preserving the quality <strong>of</strong> its neighborhoods,<br />

commercial districts, and the quality <strong>of</strong> life through effective land use planning.<br />
