5.9.4 Allowable Locations for Adult Entertainment Uses:<br />

Adult Entertainment Uses are allowed only within certain boundaries within the <strong>Town</strong>'s<br />

Industrial-General (IG) District, described as follows:<br />

INDUSTRIAL-GENERAL ZONE (WEST)<br />

Beginning at a point on the southerly side <strong>of</strong> Sturbridge Road (U.S. Route 20) at the<br />

Sturbridge <strong>Town</strong> line; thence southerly on Sturbridge line until it comes to a point in the<br />

northerly line <strong>of</strong> the abandoned road known as Major Hill Road; thence easterly on the<br />

northerly line <strong>of</strong> Major Hill Road until it comes to a point 50 feet west <strong>of</strong> Globe a.k.a.<br />

McKinstry Brook; thence northerly 50 feet West <strong>of</strong> and parallel to the west bank <strong>of</strong> the<br />

brook until it comes to the southerly line <strong>of</strong> Sturbridge Road; thence westerly by the<br />

southerly side <strong>of</strong> said road to the point <strong>of</strong> beginning.<br />

All <strong>of</strong> the provisions <strong>of</strong> other Sections <strong>of</strong> this Zoning Bylaw shall continue to so apply except<br />

when such provisions conflict with the provisions <strong>of</strong> this section; in case <strong>of</strong> such conflict, the<br />

provisions <strong>of</strong> this section shall control.<br />

5.9.5 Rules and Application Requirements:<br />

5.9.5.1 The special permit granting authority, the <strong>Charlton</strong> Planning Board, shall adopt<br />

and from time to time amend rules relative to the issuance <strong>of</strong> the permits, and shall file a copy <strong>of</strong><br />

said rules in the Office <strong>of</strong> the <strong>Town</strong> Clerk.<br />

5.9.5.2 No special permit shall be granted by the Planning Board for an Adult<br />

Entertainment Establishment, Adult Bookstore, Adult Video Store, Adult Paraphernalia Store,<br />

Adult Motion Picture Theater or Adult Live Entertainment Establishment unless the following<br />

conditions are satisfied:<br />

A. When submitting a proposal for a special permit under this Bylaw, the applicant shall<br />

obtain a copy <strong>of</strong> the application and procedures from the <strong>Charlton</strong> Planning Board, the<br />

special permit granting authority. The applicant shall file one copy <strong>of</strong> the application<br />

with the <strong>Town</strong> Clerk and deliver a second, date stamped copy <strong>of</strong> the application form to<br />

the Office <strong>of</strong> the Planning Board. All applications shall be accompanied by fifteen (15)<br />

copies <strong>of</strong> the permit applied for.<br />

B. Dimensional Requirements: The proposed use and the building or structure<br />

containing it shall meet minimum distance separations from the property line <strong>of</strong> other<br />

types <strong>of</strong> uses as outlined below:<br />

1. a minimum <strong>of</strong> two hundred fifty (250) feet from any residential district<br />

designated by <strong>Charlton</strong> Zoning Bylaws.<br />
