H. Enforcement<br />

(1) Legal Restrictions: Affordable units shall be rented or sold subject to deed covenants,<br />

contractual agreements, and/or other mechanisms restricting the use and occupancy, rent level,<br />

and sales prices <strong>of</strong> such units to assure their affordability. All restrictive instruments shall be<br />

subject to review and approval by the Planning Board.<br />

(2) Administration: The Planning Board will be the authority that will monitor, oversee and<br />

administer the details for all resale <strong>of</strong> any affordable units created under this Bylaw. The<br />

Planning Board may appoint an administrative agent to assist with the implementation <strong>of</strong> this<br />

bylaw.<br />

(3) Maintaining Local Affordable Housing Inventory: The Planning Board shall maintain the<br />

Affordable Housing Inventory, to ensure compliance with approved plans.<br />

5.16 Small Wind Turbines<br />

A. Purpose and Intent<br />

It is the purpose <strong>of</strong> this regulation to promote the safe, effective and efficient use <strong>of</strong> small wind<br />

energy systems installed to reduce the on-site consumption <strong>of</strong> utility supplied electricity.<br />

Additionally, the purpose <strong>of</strong> the regulation is to promote -alternative energy sources, reduce peak<br />

power demands in existing utility power grids, reduce reliance on fossil fuels, and provide<br />

choices to property owners that have possible cost savings and positive environmental impacts.<br />

B. Definitions<br />

1. Small Wind Turbine: A wind energy conversion system consisting <strong>of</strong> a wind turbine, a<br />

tower, and associated control or conversion electronics, which has a rated capacity <strong>of</strong> not<br />

more than 20 kW and which is intended to provide power primarily for on site uses as<br />

opposed to generation for sale to the commercial power grid.<br />

2. Tower Height: The height above grade <strong>of</strong> the fixed portion <strong>of</strong> the tower, excluding the<br />

wind turbine itself.<br />

C. Submission Requirements<br />

The applicant shall provide thirteen (13) copies <strong>of</strong> each <strong>of</strong> the following to the Planning Board as<br />

part <strong>of</strong> the site plan application:<br />

1. A completed application form with a review fee.<br />

2. Existing Conditions site plan prepared by a Pr<strong>of</strong>essional Engineer and Pr<strong>of</strong>essional<br />

Registered Land Surveyor drawn in sufficient detail to show the following:<br />
