5.9.2 General:<br />
Special permits shall be required to authorize the establishment <strong>of</strong> adult bookstores, adult video<br />
stores, adult paraphernalia stores, adult live entertainment establishments or adult motion picture<br />
theaters as hereinafter defined. Such permit shall require specific improvements, amenities and<br />
locations <strong>of</strong> proposed uses for which such permit may be granted. All proposals for Special<br />
Permits under this Section shall also require Site Plan Review under Section 7.1.4 <strong>of</strong> the<br />
<strong>Charlton</strong> Zoning Bylaw.<br />
5.9.3 Definitions - As used in this Section the following words shall have the following<br />
meanings:<br />
Adult Entertainment Establishment - any building, stage, structure, prop, vehicle or trailer that is<br />
utilized for the substantial purpose(s) <strong>of</strong> depicting or describing sexual conduct or <strong>of</strong>fering<br />
sexual excitement, each as defined in MGL, Chapter 272, Section 31.<br />
Adult Bookstore - An establishment having as a substantial or significant portion <strong>of</strong> its stock in<br />
trade, books, magazines, and other matter which are distinguished or characterized by their<br />
emphasis on depicting, describing, or relating to sexual conduct or excitement as defined in<br />
MGL, Chapter 272, Section 31. For purposes herein, "substantial or significant portion <strong>of</strong> stock"<br />
shall mean more than twenty-five percent (25%) <strong>of</strong> the subject establishment's inventory or more<br />
than twenty-five percent (25%) <strong>of</strong> the subject premise's gross floor area.<br />
Adult Motion Picture Theater - An enclosed building used for presenting videos, movies or other<br />
film materials distinguished by an emphasis on matters depicting, describing, or relating to<br />
sexual conduct or sexual excitement as defined in MGL, Chapter 272, Section 31.<br />
Adult Paraphernalia Store - An establishment having as a substantial or significant portion <strong>of</strong> its<br />
stock devices, objects, tools, or toys which are distinguished or characterized by their association<br />
with sexual activity, including sexual conduct or sexual excitement as defined in MGL, Chapter<br />
272, Section 31. For purposes herein, "Substantial or significant portion <strong>of</strong> stock" shall mean<br />
more than twenty-five percent (25%) <strong>of</strong> the subject establishment’s inventory or more than<br />
twenty-five percent (25%) <strong>of</strong> the subject premises' gross floor area.<br />
Adult Video Store - An establishment having as a substantial or significant portion <strong>of</strong> its stock in<br />
trade, videos, moves or other film material which are distinguished or characterized by their<br />
emphasis depicting, describing, or relating to sexual conduct or sexual excitement as defined in<br />
MGL, Chapter 272, Section 31. For purposes herein, "substantial or significant portion <strong>of</strong> stock"<br />
shall mean more than twenty-five percent (25%) <strong>of</strong> the subject establishment’s inventory or more<br />
than twenty-five percent (25%) <strong>of</strong> the subject premises' gross floor area.<br />
Adult Live Entertainment Establishment -Any establishment which displays live entertainment<br />
which is distinguished or characterized by its emphasis depicting, describing or relating to sexual<br />
conduct or sexual excitement as defined in MGL, Chapter 272, Section 31 and which excludes<br />
minors by virtue <strong>of</strong> age.<br />
