Preferred Alternative<br />

Based on the evaluation and comparison of the three remedial alternatives, the Army proposes<br />

Alternative 2, Land Use Controls Including Use Prohibitions, as the preferred alternative for<br />

implementation at the DRO MRA. This alternative was developed assuming unrestricted<br />

(e.g., residential) use is prohibited.<br />

• Deed Restriction.<br />

• MEC Recognition and Safety Training.<br />

• Construction Support.<br />

• Residential Use Prohibition.<br />

It should be noted that (1) grading activities are part of redevelopment activities and are not considered<br />

part of the Land Use Control remedial alternatives; and (2) compliance with environmental requirements<br />

associated with redevelopment would be the reuser’s responsibility.<br />

These Land Use Controls will be implemented in accordance with Land Use Control Guidelines. After the<br />

signature of the ROD, the current deed and Covenant to Restrict the Use of Property will be modified, if<br />

necessary, to be consistent with the final remedy.<br />

At the time of five-year reviews, the Army will evaluate the effectiveness of each of the remedial land use<br />

controls. If experience indicates that no MEC items have been found in the course of development,<br />

redevelopment, or reuse of an area, it is anticipated that the requirements may, with the approval of the<br />

regulatory agencies, be modified or discontinued.<br />

It should be noted that the City of Del Rey Oaks has already agreed to additional requirements in a<br />

separate agreement with DTSC, including:<br />

• Excavation <strong>Ord</strong>inance— The City has designated all real property within the City’s land use<br />

jurisdiction which was formerly part of <strong>Fort</strong> <strong>Ord</strong> and identified as a possible location of UXO as an<br />

“<strong>Ord</strong>nance Remediation District” (“District”). The City of Del Rey Oaks has adopted an ordinance to<br />

control and restrict excavation and movement of soil in the <strong>Ord</strong>nance Remediation District that<br />

includes the DRO MRA.<br />

• <strong>Site</strong>-Wide Construction Support—The City of Del Rey Oaks requires that any soil disturbance<br />

projects involving 10 cy of soil be conducted with construction support.<br />

In the event a suspected MEC item is discovered at the site, the reuser is to immediately report to the local<br />

law enforcement agency. In accordance with established procedures, the local law enforcement agency<br />

will in turn request a response by authorized UXO-qualified personnel (e.g. an Explosive <strong>Ord</strong>nance<br />

Disposal [EOD] unit) who will promptly be dispatched to destroy or otherwise take control of the<br />

reported military munitions item.<br />

17.2.2 Remedy Implementation<br />

Implementation of the remedy will begin following finalization of the ROD.<br />

17.2.3 System Operations and Maintenance<br />

Long-term management measures comprised of a deed notice, annual monitoring and reporting, and fiveyear<br />

review reporting would be included (the existing deed notice would be maintained) for the DRO<br />

MRA to (1) warn property owners of potential MEC risks associated with intrusive activities,<br />
