11 Venues<br />
11.1 NBLL and the Franchisee acknowledge that the provision of:<br />
(a) the same Venue for its official competition home games; and<br />
(b) a Venue of a suitable standard, is imperative to the achievement and enhancement<br />
of the operation and value of NBLL, the National <strong>Basketball</strong> League and the<br />
Business.<br />
11.2 It shall be the responsibility of the Franchisee to provide a suitable Venue for each home<br />
game for its Team. The Franchisee agrees and acknowledges that the Board may, notwithstanding<br />
the contents of any game playing draw already issued, specify from time to<br />
time in respect of the Franchisee the location and minimum specifications for a Primary<br />
and/or Alternative Venue and the equipment therein. Upon NBLL giving the Franchisee<br />
10 working days written notice of any such Venue location and specifications, the same<br />
shall apply (as a variation of this agreement) for the League Playing Seasons during the<br />
terms of this Agreement.<br />
11.3 Immediately after publication of the draw for the 2007 League Playing Seasons, the<br />
Franchisee shall make every endeavour to book the Primary Venue for each home game<br />
specified for its Team in that draw or if not available the Alternative Venue, and take<br />
all necessary steps to ensure that those bookings are confirmed, subject to the Venue’s<br />
confirmation/booking policy.<br />
11.4 The Franchisee acknowledges and agrees that the acceptance by NBLL of a Venue (as<br />
suggested by the Franchisee in any one League Playing Season) shall not mean that that<br />
Venue shall be acceptable as the venue for the home games of the Team in any subsequent<br />
League Playing Season. NBLL acknowledges that it desires to have a Team operating<br />
in the area in which the Franchisees presently operates its Team and that there are<br />
in some cases restriction on the availability or existence of suitable Venues that meet<br />
NBLL’s desired minimum venue standards. NBLL acknowledges that it is material to<br />
the availability of the venues that NBLL publishes its in the required time and that it<br />
together with BBNZ shall work with the relevant Franchisees and the potential venue<br />
providers to arrange better or more suitable Venue facilities.<br />
11.5 The Franchisee further acknowledges that the <strong>Operations</strong> <strong>Manual</strong> contains certain<br />
minimum standards for venues for the National <strong>Basketball</strong> League games which will<br />
include requirements as to sound system, scoring system, availability of media facilities,<br />
changing rooms, referees facilities, etc. The Franchisee acknowledges that the approval<br />
by NBLL of a Venue desired by the Franchisee for its home games may be made conditional<br />
upon the Franchisee ensuring (at its cost if necessary) that the necessary equipment<br />
(that does not require any structural alterations to the Venue), is provided by the<br />
Franchisee to achieve those minimum Venue standards.<br />
12 Franchise Council Meetings<br />
12.1 NBLL will arrange meetings of the Franchisee Delegates at least twice annually in order<br />
to promote good relations between them and to discuss matters of mutual interest and<br />
methods of improving the efficiency and standard of the National <strong>Basketball</strong> League.<br />
12.2 The normal business of the Franchise Council shall be to discuss:<br />
National <strong>Basketball</strong> League operational matters competition calendar and events future<br />
Franchise expansions <strong>Operations</strong> <strong>Manual</strong> and Competition Rule variations player eligibility<br />
any matters referred to it by NBLL for consideration.<br />
