) The report must be lodged within 48 hours of the completion of the event to:<br />
i) The President/Chairman of the relevant Association — in relation to an alleged<br />
offence in an Affiliated Association activity;<br />
ii) The Chair of the Tournament Committee — in relation to an alleged offence at<br />
a BBNZ Tournament;<br />
iii) To the League Manager (if any appointed for the relevant League and if not<br />
to the BBNZ CEO) — in relation to an alleged offence in a League game or in<br />
relation to a League; and<br />
iv) the BBNZ CEO — in relation to all other alleged offences.<br />
8.3 In the case of an alleged offence occurring in a basketball event (not being a game) the<br />
report must be lodged within 48 hours of the completion of the event, to:<br />
a) the President/Chairperson of the relevant Association — in relation to an alleged<br />
offence in an Affiliated Association activity;<br />
b) the Chair of the Tournament Committee — in relation to an alleged offence at a<br />
BBNZ Tournament;<br />
c) to the League Manager (if any appointed for the relevant League and if not to the<br />
BBNZ CEO) — in relation to an alleged offence in a League game or in relation to a<br />
League; and<br />
d) the BBNZ CEO — in relation to all other alleged offences.<br />
8.4 The recipient must sign the report and write the date and time they received the report.<br />
9 Does the Complaint Warrant a Hearing?<br />
9.1 The recipient should be required to make a decision whether or not to refer the alleged<br />
offence to Judicial Committee. The recipient does not have to give reasons for the determination.<br />
The recipient may obtain information from officials, in helping with the determination.<br />
9.2 If the recipient determines that the report relates to conduct that:<br />
a) is not sufficiently serious to require a hearing, and<br />
b) the alleged offender has not within the period of the six months preceding the report<br />
been found guilty of an offence,<br />
then the recipient can determine, in the recipient’s sole discretion, not to refer the report<br />
to a Judicial Committee.<br />
9.3 In making a determination not to refer the conduct to a Judicial Committee, the recipient<br />
may determine that the alleged offence is sufficiently serious to warrant a written caution,<br />
in which case:<br />
a) the recipient shall issue a written caution to the alleged offender report; and<br />
b) provide a copy of that caution to the President/Chairperson of the relevant Association,<br />
the Chair of the Tournament Controller, League Commissioner or the<br />
BBNZ CEO, as the case may require and the complainant.<br />
9.4 If the recipient determines that the alleged offence shall not go to a Judicial Committee<br />
the recipient shall advise the person making the report and the alleged offender of that<br />
decision.<br />
9.5 If the recipient determines that the alleged offence shall be referred to a Judicial Committee<br />
the recipient will:<br />
