METROPOLITAN COAL PROJECT INDEPENDENT ENVIRONMENTAL AUDIT<br />

Management Plan).<br />

Performance measures and indicators for the monitoring program (Section 5 of the<br />

management plan).<br />

Programs of works to monitor the impacts, environmental performance and the effectiveness<br />

of management measures (Section 5 and 12 of the management plan).<br />

Contingency plan to manage unpredicted impacts and their consequences (Section 9 and 10<br />

of the management plan).<br />

Protocol for managing and reporting incidents, complaints, non-compliances, exceedences of<br />

impact assessment criteria (Sections 13, 14 and 15 of the management plan).<br />

Protocol for the periodic review of the plan (Section 12 of the management plan).<br />

Through the preparation of the Biodiversity Management Plan, <strong>Metropolitan</strong> <strong>Coal</strong> has satisfied <strong>Project</strong><br />

Approval Schedule 3 condition 4(c) and 6(f) and Schedule 7 condition 2.<br />

4.3.2 Biodiversity Assessment<br />

<strong>Project</strong> Approval Schedule 3 Condition 1 requires that the proponent demonstrate the environmental<br />

performance of the project in relation to several specific values. In particular the condition indicates a<br />

performance measure of negligible impact to threatened species (NSW Threatened Species<br />

Conservation Act 1995) populations and ecological communities and Upland Swamps numbered 76,<br />

77 and 92.<br />

Related to this primary matter is the performance of the project in relation to a negligible impact to<br />

watercourses (Waratah Rivulet and the Eastern Tributary) and to cliffs (a performance measure of no<br />

more than 3% of the length of cliffs within the study area may experience rock falls). These secondary<br />

matters are relevant to the current audit as the watercourse and cliff values potentially provide<br />

important habitat resources for one or more threatened species, population or ecological<br />

communities.<br />

The <strong>Metropolitan</strong> <strong>Coal</strong> <strong>Project</strong> Environmental Assessment outlines the results of extensive surveys for<br />

threatened species, populations and ecological communities. Specifically, Page ES-19 and ES-20 of<br />

the executive summary list the following threatened species as occurring within the project study area.<br />
