further monitoring to determine whether these measures<br />

ensure compliance; or<br />

(b) secure a written agreement with the landowner to allow<br />

exceedances of the relevant impact<br />

assessment criteria,<br />

to the satisfaction of the Director-General.<br />

However, if the further monitoring referred to under paragraph (a)<br />

above determines that the project is complying with the relevant<br />

impact assessment criteria, then the Proponent may discontinue the<br />

independent review with the approval of the Director-General.<br />

If the independent review determines that the project is not complying<br />

with the relevant land acquisition criteria in schedule 4, then the<br />

Proponent shall offer to acquire all or part of the landowner’s land in<br />

accordance with the procedures in conditions 5-7 below, to the<br />

satisfaction of the Director-General.<br />

LAND ACQUISITION<br />

5/5 Within 3 months of receiving a written request from a landowner with<br />

acquisition rights, the Proponent shall make a binding written offer to<br />

the landowner based on:<br />

(a) the current market value of the landowner’s interest in the<br />

property at the date of this written request, as if the property was<br />

unaffected by the project the subject of the project application, having<br />

regard to the:<br />

(b)<br />

existing and permissible use of the land, in accordance with<br />

the applicable planning instruments at the date of the written<br />

request; and<br />

presence of improvements on the property and/or any<br />

approved building or structure which has been physically<br />

commenced at the date of the landowner’s written request,<br />

and is due to be completed subsequent to that date, but<br />

excluding any improvements that have resulted from the<br />

implementation of ‘reasonable and feasible measures’ in<br />

condition 3 of schedule 4 or condition 4(a) of this schedule;<br />

the reasonable costs associated with:<br />

relocating within the Wollongong local government areas, or<br />

to any other local government area determined by the<br />

Director-General;<br />

obtaining legal advice and expert advice for determining the<br />

acquisition price of the land, and the terms upon which it is<br />

to be acquired; and<br />

(c) reasonable compensation for any disturbance caused by<br />

the land acquisition process.<br />

However, if following this period, the Proponent and landowner cannot<br />
