Rail Noise<br />
4/4 The Proponent shall only use locomotives that are approved to<br />
operate on the NSW rail network in accordance with noise limits L6.1<br />
to L6.4 in Rail Corp’s EPL (No. 12208) and ARTC’s EPL (No. 3142) or<br />
a Pollution Control Approval issued under the former Pollution Control<br />
Act 1970.<br />
4/5 The Proponent shall use its best endeavours to minimise night-time<br />
movements of rolling stock on the <strong>Metropolitan</strong> rail spur.<br />
4/6 In the event of any rail noise or vibration issues that may arise from<br />
the haulage of coal over the life of the <strong>Project</strong>, the Proponent shall<br />
liaise with the CCC and the rail service provider to facilitate resolution<br />
of these issues and implement additional noise reduction measures<br />
where appropriate.<br />
Blasting<br />
4/7 The Proponent shall not undertake blasting operations at the surface<br />
facilities area without the written approval of the D-G.<br />
Noise Management Plan<br />
4/8 The Proponent shall prepare and implement a Noise Management<br />
Plan for the project to the satisfaction of the Director-General. This<br />
plan must be prepared in consultation with DECC by a suitably<br />
qualified expert whose appointment has been approved by the<br />
Director-General, and submitted to the Director-General for approval<br />
by the end of June 2010. It must also provide for real-time noise<br />
monitoring.<br />

2000 and the works were approved by the EPA as<br />
satisfying condition 9 of the SRA Pollution Control<br />
Approvals No. 000993 and 000994.<br />

September 2010 stated that “efforts to minimise<br />
noise impacts on the community, and reaffirmed<br />
of Schedule 4 condition 5 of <strong>Metropolitan</strong> <strong>Coal</strong>'s<br />
<strong>Project</strong> Approval which states that the colliery<br />
must use its best endeavours to minimise night<br />
time movements of rolling stock on the<br />
