INTERNATIONAL AND REGIONAL COMMITMENTS ANNEX I.<br />

Under the Nepal Treaty Act 1990, international instruments<br />

to which Nepal is party have the force <strong>of</strong> law in Nepal, and<br />

the provisions <strong>of</strong> international instruments prevail over domestic<br />

law where the two conflict. 162 The Supreme Court has ruled<br />

that the provisions <strong>of</strong> international instruments to which Nepal<br />

is a party supersede domestic law.<br />

INTERNATIONAL COMMITMENTS<br />

Nepal has undertaken the following international commitments,<br />

whether binding in international law or non-binding:<br />

· Supplementary Convention on the Abolition <strong>of</strong> Slavery,<br />

Slave Trade and Institutions and Practices Similar<br />

to Slavery, 1956 (ratified in 1963)<br />

· UN Convention on the Rights <strong>of</strong> Child (CRC), 1989<br />

(ratified in 1990)<br />

· UN Convention on the Elimination <strong>of</strong> all Forms <strong>of</strong><br />

Discrimination against Women (CEDAW), 1979<br />

(ratified in 1991)<br />

· Stockholm Declaration and Agenda for Action, 1996<br />

(party to the Declaration)<br />

· ILO Minimum Age Convention (No. 138) on Minimum<br />

Age for Admission to Employment, 1973 (ratified<br />

in 1997)<br />

· ILO Convention (No. 182) on the Prohibition and<br />

Immediate Action for the Elimination <strong>of</strong> the Worst<br />

Forms <strong>of</strong> Child <strong>La</strong>bour, 1999 (ratified in 2000)<br />

· ILO Forced <strong>La</strong>bour Convention (No. 29) on Forced<br />

or Compulsory <strong>La</strong>bour, 1930 (ratified in 2001)<br />

· Yokohama Global Commitment on the Commercial<br />

Sexual Exploitation <strong>of</strong> Children, 2001 (party to the<br />

Commitment)<br />

· UNGASS Declaration, A World Fit for Children, 2002<br />

(party to the Declaration)<br />

· Optional Protocol <strong>of</strong> the Convention on the Rights<br />

<strong>of</strong> the Child on the Sale <strong>of</strong> Children, Child Prostitution<br />

and Child Pornography, 2000 (ratified in 2005)<br />

· Optional Protocol <strong>of</strong> the Convention on the Rights<br />

<strong>of</strong> the Child on the Involvement <strong>of</strong> Children in Armed<br />
