Code <strong>of</strong> Conduct for Journalists, 2060<br />
This code <strong>of</strong> conduct required journalists in all forms <strong>of</strong> media<br />
to respect the confidentiality and identity <strong>of</strong> victims <strong>of</strong> sexual<br />
violence as well as people living with HIV/AIDS. Nepal journalists<br />
have in general abided by <strong>this</strong> Code <strong>of</strong> Conduct since 2003.<br />
Safe Abortion Service Procedure, 2060<br />
These procedures ensured that women are protected from<br />
forced abortion by the requirement <strong>of</strong> signed voluntary consent,<br />
and are ensured confidentiality by medical practitioners regarding<br />
the proceedings.<br />
2004<br />
National Plan <strong>of</strong> Action for Children, 2004/05 – 2014/15<br />
The 10-Year National Plan <strong>of</strong> Action for Children amends a<br />
number <strong>of</strong> gaps in the trafficking NPA and is a more detailed,<br />
comprehensive <strong>document</strong>. Programmes include, among else,<br />
reviewing legislation with a view towards addressing sexual<br />
exploitation, abuse and harassment; reviewing and amending<br />
laws regarding the age <strong>of</strong> children; strengthening the participation<br />
<strong>of</strong> children in policy-making; addressing child labour issues;<br />
strengthening monitoring and response to child abuse at the<br />
local level; and developing mechanisms to protect street<br />
children. However, <strong>this</strong> plan, like the trafficking NPA, is<br />
dependent on the government at the district and local levels<br />
for facilitation, and lacks adequate mechanisms for involving<br />
NGO and community stakeholders.<br />

As a result <strong>of</strong> <strong>this</strong> case, the Supreme Court ordered the<br />
government to take ‘necessary steps‘ and initiatives to enact<br />
appropriate laws relating to sexual harassment.<br />
Master Plan on Child <strong>La</strong>bour, 2004 – 2014<br />
This <strong>document</strong> provides limited guidelines to address the<br />
concerns <strong>of</strong> children in the entertainment and sex industry.<br />
It reiterates the Nepal <strong>La</strong>bour Act 1991 in classifying work in<br />
hotels, restaurants and casinos (massage parlours are excluded),<br />
as well as prostitution, as worst forms <strong>of</strong> child labour, but<br />
provides few recommendations to implement that act or its<br />
2000 amendment. Actions to prevent the extreme worst<br />
forms <strong>of</strong> child labour, such as trafficking, are limited to<br />
monitoring ‘embarkation and disembarkation points’ and<br />
conducting ‘training and education’, while actions to prevent<br />
child labour in the forbidden areas <strong>of</strong> the service sector,<br />
such as bars, are limited to adopting codes <strong>of</strong> conduct. There<br />
are no firm actions to strengthen laws and enhance the<br />
prosecution <strong>of</strong> <strong>of</strong>fenders. The foundation <strong>of</strong> data with which<br />
it was developed is questionable as, according to its Annex<br />
2.5 Status <strong>of</strong> Child <strong>La</strong>bour in Nepal, only 150 children are<br />
claimed to be working as sex workers in Kathmandu, and<br />
there is no mention <strong>of</strong> internal trafficking <strong>of</strong> children for<br />
prostitution.<br />
